Wrong item sent- surely I haven't got to pay to return?

    So in other words, the seller is actually being reasonable and offering to pay the cost of return - but its you that being awkward.

    good job few citizens of UK uphold the law - if we all copped the attitude of 'let it lie - he's dead now and murders "happen"

    I have to agree with you on this... seller has accepted the error and offered to refund postage.

    One question though... I thought that ebay auctions were exempt from DSR unless they are offered as a buy it now of if the seller makes a business from selling through ebay. I'm not 100% sure of the exact details.

    If I'm correct though how can Jethro (and others) claim this comes under DSR's?
    I don't believe that the OP has told us the detail of the purchase so surely it may be exempt.
  • Whether it's exempt or not, morally the right thing for the seller to do would be to pay for the return. Seller's who won't in these circumstances, won't stay in business for long.

    I do agree though; at some point there has to be trust and OP probably needs to take seller at their word rather than assuming that they will not do as they said. I am sure some would get away with not paying out the return postage but if we all go around assuming everyone on ebay is dishonest in some way, we may as well not bother using it at all.
