Fraudulent mobile phone contract

I was wondering if someone can help me.

This morning I had a letter from 3 delivered through my door with my name on it and a direct debit agreement.

I have not got a mobile phone with 3 neither has my husband (were both with T-mobile)

I called them and they state I ordered "the one" contract at £41 a month with a brand new samsung phone and I haven't! No delivery has been made here nor did I order one.

They didn't seam too keen to be able to help. They simply said unless I can prove I didn't order it (who can?) then this is my contract! HELP!

  • Did you tell them you suspected Fraud? I would call back to report fraud, they should block the IMEI of the phone they sent.

    It might also be worth registering this with Police if you feel you aren't getting anywhere.

    Of course, someone has got your details some way or other to make them think you have ordered in the first place. I trust things are shredded etc.

    completely agree, find out what card has been used to purchase the phone and contract. Then contact the card company and inform them of the same, they can, if nothing else, suspend the DD.

    Speak to 3 and inform them that this is a fraudulent claim.

    100% sure it is they who has to prove that you ordered, not vice versa.

    However, they can and will routinely trash your credit history if you are not proactive with this problem.

    Was the DD set up on your account? If so, the fraudster has hell lot of your personal information.
  • I called the bank right after I wrote this to see if a DD had been set up and it had. Also a payment to 3 was made using my bank card for £29 about a week or so ago too. They have cancelled the DD and my card and are sending me a new one. They simply said my details/card must have been cloned.

    As for 3 I have not spoken to them again yet but I will be doing tomorrow because I'm not being billed for something that's not mine. Quite how they managed to do this I have no idea!

    Everything in this household is shredded. My husband is a soldier and because there is paperwork from work that even I'm not supposed to look at he's REALLY anal about shredding.

    I'm still shocked at how they can simply say "this phone was delivered to your house in your name" yet no phone has turned up and only myself and my husband live here.

    If you look at from the companies point of view, they have received an order from 'you' for a phone, paid for it, and now you're saying it wasn't you.

    Most companies tend to just stay away from fraudulent claims and wait for the banks to tell them to refund the money.

    It's extremely unfair but it's how most companies will work it.

    And what if it's a 'free' phone and there is no anything to refund?
  • Totally agree with that. After all they don't know me from Adam, I've never been a customer with them. As far as I am concerned they can keep what they've already taken but I will be doing everything possible to make sure I'm not liable for a contract and a phone I never started.

    I did a little bit of googling to see if anyone had had it happen to them. It seam's vodafone and 02 deal with it fairly straight forward (block the IMEI and remove delete the contract) however I have a feeling 3 won't be an easy one to handle.
  • According to 3 it's a samsung galaxy s3 and the contract price is £41pm plus £29 up front (not too sure what that's for I was still quite speechless at the time)
