Fencing issue

Hi,
My neighbour has not replaced the fence panel at the side of my extension.
Their water is running off from their garden straight into my extension wall & hence damp, did mention in previous posts they have built over the damp proof course.

Also they have drilled a basket holder onto the wall of my extension, i might add its an unrendered wall as well.
Would fitting a drain around the wall help the problem?

Problem is if they put their fence back (will cause access problems on my part), they have fitted their kitchen outlet drainage pipes on my side of the fence. Hence if they put the fence back, then their kitchen drain pipes will be on my side.

Been around a few times to say hi as we are new neighbours, but either not in, or not interested :(

What i am asking is, should i insist they put the fence back to stop their water flowing into my walls? & who is liable for damp problems for building over the DPC?, called building control, but they are not interested despite signing the job off!!

Bit confused i am sure you managed to gather, thanks in advance for any thoughts.

    I'm not sure how a fence panel would prevent water ingress into an extension wall - it sounds like the building above the DPC is causing your damp problems. May help if you explain what exactly they've built - is it a patio or have they just piled dirt up against it?

    Sorry will try & post some pics!, in essence next door have "taken" land belonging to me by not putting up their fence panel & effectively using my extension wall as part of their property (i.e drilling into my wall!).

    The damp issue i am sure is because they have built over the dpc, but will drains around my property solve the issue or will i need to dig up into the DPC?, who is liable for that?.

    Will try to take some pics once its stopped raining!

    whats built up over the dpc patio slabs or soil?
    dont see that they drilled a hanging basket off your wall as a major problem
    technically they are to blame if they built over your dpc but not sure how it works on who pays to rectify
    also dont know why they have put there drainage through your property
    as above pics would help alot

    If so I have difficulty in believing that you actually bought the place without resolving this issue.

    Putting a fence up will not stop the water flow.

    Where is the boundary? Your extension should not be right up to the boundary.

    If they have "filled in" to bridge your DPC then you should ask them to remove the infill back to their side of the boundary and provide a drain which should be their side of the fence once reinstated. Its not up to you to put a drain in to cater for their activities its up to them.

    They are not entitled to drill into your wll irrespective of where the boundary is.without your permission. Invite them to remove it.

    Not just technically but actually and it should be to their cost not the OPs.

    They haven't. It just runs freely as I read it.

    But here's the thing, who can force them to do the works? & in the meanwhile i still have damp coming up the wall near live electrics :(. Will post pics asap, sorry they have put in wood decking all over the garden & then concreted shingle mix where the boundary should be.

    Their kitchen waste pipes are on my side of the fence, so should a fence go up, they effectively won't be able to access their own pipes!

    Yes i was silly not to get this looked at, but the rics surveyor didn't pick it up as there were high fences put in on my side & due to disability could never have bought the fence down/looked over it. Can't even see it from the upper rooms as the flat roof hides that bit as well. Suppose to late to go to the solicitor now!!

    There shouldn't be a question of forcing anyone to do anything. All that will do is throw up brick walls (sorry).

    First you need to establish where the boundary is and then armed with that information go and see them or invite them round for a cup and have a pleasant chat about the problems they have created for you and ask what they intend to do to remedy the situation. No need for confrontation.

    Keystone i see your local to me, fancy being my mse buddy negotiator? lol!.

    Think your right, but been right there twice, once they were at work, the other time they didn't open the door & i have not even properly moved in yet. Funny thing nothing was put on the forms about any issues with the neighbours!

  • i must admit i'm having trouble visualising this, how can their pipes be on your land if the fence goes back up & you said you couldn't look over the fence to see anything which suggests the pipes etc are on their side.
