Fake Item bought on ebay help

Hi wondering if anyone can help, bought an item on ebay but completed the sale privately and paid via bank transfer I have an invoice from the seller and the advert stating the item is genuine with a description.... item arrives its fake! im out of pocket and the seller is saying no refund!! and claims the item is genuine I've had it checked definately not the case, where do I stand is there any way I can get my money back?:mad::mad:

    If the seller is overseas forget it, if in EU or UK send them a recorded letter demanding your funds, and an email to the same effect, in it tell them you will be contacting the company whose trademark you believe to have been infringed.

  • yes trading standards is my next step i've also emailed louis vuitton to ask them to clarify its fake, I am so annoyed with this seller even if i don't get my money back I want to make sure other people are victims
  • in an email I have sent the seller I have said I will give 7 days to refund? shall I wait until 7 days has passed before I email again or go straight to trading standards the reply to the email I sent says she was consulting a solicitor and contacting ebay regarding my comments to her.

    what she means is telling her the item was fake!

    Has the seller not breached Ebays selling terms by taking the payment outside of Ebays control?

    This is why so many sites like Ebay and Amazon encourage you to sell and buy through the site, as it significantly reduces fraudulent claims.

    If the seller is a company you may be able to get your money back from them using trading standards and DSR. if however, your seller is just some bloke living in Godknowswhere, you may have a bit of a struggle on your hands!

    Unfortunately, demanding your money back can be deleted in a simple mouth stroke and a chuckle.

    Follow this up promptly, do not allow the 7 days to pass

    Seller isn't in Hull is he? Same happened to me...and when I returned it, it apparently 'got lost'...so I lost out big time!

    I did...well I sent it recorded...

    ...to this day it still says 'progressing through the system'!!!
