  • Good luck to you and your neighbour with getting it sorted.

You seem very caring and compassionate. Hope your neighbour gets well soon.

If you don't have a copy of the ESA85 just tell them that you will give the reasons for the appeal when you have received the ESA85 or copies of the following information
    1. The ESA85
    2. The ESA85 Decision Makers Scoresheet
    3. The ESA65
    4. All the Medical Information the HCP used to make their opinion
    5. All the Medical Information the Decision Makers Office used to make their decision
    6. The ESA113
On the GL24 ask to be placed on the assessment rate until the tribunal.
    1. Won't be an ESA85 an a F2F assessment didn't take place. It will be an ESA85A.

    2. Doubtful that there will be a scoresheet, again only generally done if F2F takes place.

    3. ESA 65's Written Statement of Reasons are only generally done where there is a Fit for Work decision.

    4. Yep, agree with that to cover all documentation used.

    5. Yep, agreed.

    6. There will only be an ESA113 if one was sent to the claimant's G.P., which doesn't happen that often.

There will definately be an LT54, and there might also be an ESA72.

If you want to make your request official, use a SAR :

    http://www.dwp.gov.uk/docs/request-for-personal-information.rtf

    http://www.dwp.gov.uk/privacy-policy/data-protection/

Request all documentation written or electronic to do with the ESA decision.
  • Hi ... me again
My neighbour was told at the end of January that he must have half to two thirds of his remaining kidney removed due to the kidney cancer ( he had his first kidney removed at the end of October). He was put in the Wrag group at the end of November, we appealed , as we think the support group is more suitable using the form and have heard nothing. ( money still the same) He was contacted by Jobcentre Plus in early Feb asking him to go in for an interview. This clashed with a hospital appointment. I spoke to the lady at the jobcentre plus and explained the situation. She said I should update the DWP on his condition. I did this on 4th Feb. Heard nothing, but the form Limited capability for work arrived. On the back page it asks about cancer and requests for a healthcare official to fill it in and sign it. I took it to his GP .............. and despite continuing harrasment to the surgery we've not had it back, and it has to be returned this week. I called the DWP to explain and the man said I could explain why the form is late but expect his benefit to be stopped ....... arghhhhhhh All I'm trying to do is help him, and it seems yet again I'm causing havoc.
Please can anyone confirm whether they will stop his benefit. ( He's had his pre-op, but has one or two complications ie high blood pressure needs to be reduced and a urine infection) before they will operate - but still anticipated within the next couple of weeks.
Any help/advice really appreciated - I'm totally fraught about this!
    thanks in advance
  • You need to speak to the practice manager at the surgery ASAP.
  • Hi
Yes I spoke to her on Friday, Monday and today and she said she'll do her best to get the form returned in time ................ but still nothing. I will contact her again tomorrow, but the form needs to be in the post tomorrow .
  • Another update - Form was returned on time, and this morning he's received a letter stating he's been moved from the
WRAG to the support group - HOORAY!
It doesn't say for how long, but as he's due in hospital next week, this couldn't have come at a better time.
Can I say a MASSIVE thank you for all the help/support you've given us, we'd never have got through it without you.
What a journey...... and all the very best to anyone who has to undertake it,
