Bearing in mind he has only 4 weeks from the date of the award letter to appeal and someone will phone within a fortnight and speak to him reference his situation I'd be tempted to start the ball rolling now and download the GL24 and post it off, along with a letter requesting the ESA85A etc.0 -
If you don't have a copy of the ESA85 just tell them that you will give the reasons for the appeal when you have received the ESA85 or copies of the following information
- The ESA85
- The ESA85 Decision Makers Scoresheet
- The ESA65
- All the Medical Information the HCP used to make their opinion
- All the Medical Information the Decision Makers Office used to make their decision
- The ESA113

He doesn't need to be placed on the assesment rate until the tribunal as he's appealing to be moved from the WRAG to the support. He also needs to request the ESA85A as he never went for a face to face assesment0

Be very very careful that, in the process of asking for the appointment to be rescheduled, Atos don't report this back to the DWP as a no-show. This would stop his benefits.

Funnily enough an ATOS Doctor said similar to me reference the DWP:rotfl:0 -
Funnily enough when I had a WCA I spoke to two different people at ATOS to change my appointment and was told, both times, that would be absolutely fine and it wouldn't impact on my benefit. They lied.
Fortunately for me I suspected there would be a problem and managed to persuade the DWP to sort it out before i lost any money.
I made a complaint to ATOS which they refused to deal with until as much time as their complaints procedure would allow. When I called back to find out what was happening I was laughed at.
They are scum. They are also working to DWP targets, despite the lies propagated by Grayling and IDS who are both eequally as bad.0 -
here's an update!
My neighbour /me wrote to dwp,enclosing the GL24 form and requesting ESA85A details. This letter was sent on 5/12/12 and received by them on 12/12/12. He has seen the consultant 3 times and had another CT scan since filling in he form - and it is confirmed he has cancer in his second kidney, with the operation for partial removal being scheduled before the end of the month. ( the hospital he attends is 103 miles away from home and takes just short of 3 hours one way !! ) We've heard nothing until a phone call last week from jobcentre plus asking him to go into see them as he is required to do. He explained his situation to her on the phone and she said he should send the dwp an update on his condition. I wrote a letter to them the day after the call and enclosed copies of appointments. Yesterday morning a letter from ATOS arrived with the limited capability for work form enclosed - this is the dreadful form we had a nightmare filling in 6 months ago.
Can anyone give me any advice on how to deal with the mess I seem to have put my neighbour in - he's so poorly and I want to help as I feel quite strongly that he shouldn't be having to worry at this time. ( I can't believe this stupid system and feel desperately sorry for any ill person out there who needs their benefit and has to fight for it like this - sorry rant over )

Can you write to your local MP?
Seriously.
Explain everything to him or her, and enlist their support in dealing with the DWP and ATOS directly.
I'm hoping your MP isn't a Conservative or LibDem, although, in theory, MP's of all parties are supposed to be supportive of their constituents problems, especially in these circumstances!0 -
I wonder whether contacting local media might also be a consideration. It's cases like these that need highlighting pubicly, although I can fully understand if it would be too much stress for your poor neighbour to deal with.
