    Tbh they would know from the investigation so it may be that you will get the refund. Well, u would think they would know.

    You would think so but then again I don't want to get my hopes up on it then it not come, but it would help us out no end with the house hunting and Christmas would be the first year in 6/7 years we have not struggled but if not then we will just have to get through it like every other year.

    I understand what people on here are saying that the company have a right to offset the money against there loses but at least i did it my self and not gone through a company that then i run the risk of owing them money which would have really messed things up.

    Just seen on CAG website that egg cannot offset any redress to monies that they sold on. If they sold your debt on to another company they don't own the debt and can't withold the refund.

    Most Banks "sell" their bad debt to companies which they own or have strong links to. There are many recorded instances of off-setting in these circumstances.

    The debt was sold on to arrow global and never really had anything to do with the iva as think it was sold on before I entered it not 100% sure on that one just know that when I tried to get details from them got told they had no paper work and that all they could say was that I had so much ppi added on to the loan that's all.

    I hope you are correct amz2013 in that they can't but would be my luck that moneyineptitude is right and they will lol.

  • No not yet been told it needs to go for quality checking and security checking then to be posted out which was told should be done this week and then sent next week have been pestering alot of people but hay in the stewie Griffin words "where's my money" am just waiting for a response to say where it's at.

    Just hope it does come through means we can move quicker on this house we both like. Checked my ppi questionnaire again and it does state under the default or late payments part that it was entered in to an iva in July 2006 and is ticked yes so they were aware.

    I am in the same boat. Sent mine off with certificate early octobet but I know they will say no because I sent two long rambling letters too.
  • If its a loan then you should do as mine was taken out in 2005 and was front loaded and told that on the amount £7k then I would be more inclined to get it if I take out ppi.

    If they had said claim upheld but off set against debt I would have been ok with it but when I get a letter saying they are sending a cheque to me it gets your hopes up but if I comes back not sending then will be annoyed as they should have info correct at sending letter but then nothing I can do about it.
