Pay and notice entitlement

Hi all

I'm thinking about taking voluntary redundancy. My statutory entitlement is 3 weeks pay. My contractual notice period is 7 weeks. Am I entitled to pay for notice period and statutory requirement? Or just statutory requirement? I'm about to go on maternity leave. M currently off sick. I'm assuming I would have to forfeit my enhanced mat pay. If that is the case can I delay starting maternity leave until end of notice period, or can I ask for PILON?

    The benefit of me taking VR is that I'm going to university next September, and was only going back after maternity leave for 13 weeks to ensure I receive my occupational maternity pay.

    I don't know what package I would be offered, I'm just trying to find out what my statutory entitlement is. My occupational maternity pay is worth £2278.40 above SMP, and my contractual notice is 7 weeks. My weekly pay is £305. If I'm entitled to PILON and statutory redundancy payment it is worth me applying. If it is just statutory payment than it isn't. I don't want to show my hand until I know where I stand.

    Contractual notice of 7 weeks is unusual.

    Statutory redundancy would be based on full years service.
    Notice would be contractual.

    There is a potential issue with notice pay if you are sick as it appears your contractal notice is over a week longer than the statutory notice so they would not have to pay the notice at full rate and can pay this as sick.

    You really need to find out what the VR package and how they plan to deal with notice and maternity as without that you cannot make an informed choice.

    I am not sure on the maternity pay.

    Also you need to factor in the accrued untaken holidays now and during maternity, if you cannot take before maternity will need to be taken after or get paid on termination.

    If I cannot go back to work tomorrow I will be starting my annual leave - I have 3 weeks saved up. However if it is going to mess up VR package then I'm going to try and go back (I'm in pain and on crutches so would prefer not to do this). I really do not know what to do. I guess my VR request might not be accepted either LOL.

    My notice period is 4 weeks plus a week for every complete year I have worked there, so 7 weeks.

    as I say that is very unusual contractual notice. check if it is yours and/or theirs.


    AIUI If you are sick(signed off) you do not need to start using holiday, check the maternity rules.

    there are other more versed with the maternity rules

    any one reading now?

    I'm only starting my annual leave to stop me from going on half pay, it's been my choice.

    I thought there was some rule that if sick you have to go on maternity early.

    Is the sick maternity related and when is maternity due to start?

    Are you sure about that, you would normally get one or the other, not both., I would double check.
    make the most of it, we are only here for the weekend.

    Ahh you are right, it's 4 weeks for the first 4 years of service, then an additional week for every years service up to 12 weeks. So my notice is only 4 weeks! :-)

    So if my notice period is 4 weeks and statutory redundancy pay entitlement is 3 weeks, if they agree PILON am I right in assuming I should get 7 weeks pay minimum? (More if they offer it)

    The sickness is maternity related. They can make you go on maternity leave at 36 weeks, I'm only 28 weeks. I have volunteered to take annual leave as it is more financially viable for me - I do not fancy spending the next 9 weeks on half pay it would cripple me :(
