    An interesting point, but if they were as capable as a younger person, and clearly they were capable enough to drive, and younger people were also being ticketed in the same way, it again would be hard to prove discrimination with regard to being harrassed as an elderly person.
    Probably not worth the op spending a lot of her own money in court over, without a better chance of winning, or some previous cases to quote to the judge.

    Where did I tell them to sue? I said to tell the Store Manager that she was 'minded to sue' and to point out the (potential) breaches of the Act.

    I had a feeling she may be disabled and mistook the bay for a disabled by but we'll see.

    Even if not, the fake PCN deserves proactive attention by evelyn123 to protect her Mum.

    The equality act doesn't just cover disablement it covers just about all issues under equality, including age issues that could lead from discrimination in a car park.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Maybe you should point out you meant you had no intention of suing, and it was just a word to be bandied about as a threat.
    It is a newbie you are giving advice to, and they probably aren't up to the subtle difference when they come on here for advice initially.


    Just to be clear to them though, as they may think they can follow up the threat.
    You aren't actually suggesting they do sue.

    I think just ignore would be a better option here.
  • Thanks to eveyone who has posted on here, lots of good advice, and thanks I did get the gist of all the suggestions! Might try the going into the shop she was in as it clearly seems to me this is just not something she should have been ticketed for. At present all the views have helped her see she has been victimised and not done anything illegal! So we won't be paying the ticket. Undecided about writing to them yet. Thanks again.

    She could park sideways across three disabled bays and it wouldn't be illegal.
    It would possibly be antisocial, but the bays have no legal status.
    So just ignore the ticket.

    Whether or not you think it's worth getting in a row with the manager is anther question.
    He has the job of providing parking to suit all his customers requirements.
    So be prepared for him to think disabled bays are for limited mobility, and difficulty getting in and out of the car. Parent and child spaces are wider to get the kiddy seats in without scuffing up the car next to you.
    Normal bays cover the rest.
    He will no doubt ask you to suggest a working method of how he does it, as he probably thinks his works as well as it can, without having his staff police the customers in the car park.

    The threat of court action is normally enough to force companies to do something about it.
    I myself have recovered costs from a PPC on the threat of court action against them the landlords and the owners of the land.
    Think about it I gained £100 if they defended my claim how much would it cost them for 3 representatives to attend court.
    The landlords and the owners simply told the PPC to get it sorted.
  • I had recieved one of these tickets for parking in a disabled bay on the 1st october i am may i point out disabled a T3 paraplegic disabled wheelchair user my badges were displayed in my drivers door window , i have appealled this stage one and been refused i am currently undergoing stage 2 of there appeal. The photographic evidence does not show my drivers door window but does show every other window funnily enough. After this appeal i think i can go through the popla appeal system but was wondering if all fails where do i go after this as i am not paying. i did explain the reason my badges were not in the winderscreen was my disabilty means i cannot reach them when on my own

    Please advise

    Wow, wow and more wow - they have seriously broken the Equality Act!

    I would absolutely LOVE to help you word your POPLA appeal. Please let me help you (don't worry about the outcome because POPLA is not binding on the motorist at all). By the way, others here can vouch for me I am sure. I used to work as a Disability Service Manager and am familiar with the Equality Act.

    Please come back and let us know if you get another rejection and we can do that POPLA appeal. This is shocking and you will not have to pay, in fact you will be a classic case to get compensation from the parking company of a good few hundred quid damages for you after all this illegal hassle.

    Come back and show us the response but start a new thread please when you do. From here, just click once (where my signature tells you) to go back to the main forum and off this thread, then you will see a 'New Thread' blue button on the left just above all the current forum posts.

    Click that and start your thread when you get the response - which parking company is this? You will then need to post a 'broken link' to a picture of the letter you get (i.e. remove the http ://) because you are a newbie at the moment and can't post full links yet.

  • If you do that they may think it contains a cheque payment for the illegal parking charge, but to find out UK CPS will have to pay the postage due. Obviously the envelope could be empty or contain some choice phrases and advice :-)
