using contract sim in different phone

hi everyone
Im currently with O2 and have upgraded my contract to get an iPhone 5 but with O2 I'm just out of the cooling period but with Carphone Warehouse I've got until Friday (I would have to deal with Carphone Warehouse as the contracts are with them).
I think I did the wrong thing getting an iPhone 5 as I've had one for the last 5 years and it just doesn't feel like a new phone or anything new. Don't get me wrong, its a great phone. It's just that I'm bored with iPhone.
Are there any legal implications with buying a new phone and putting my simcard into the new phone and using that instead?

I don't quite understand all this staff with O2, CPW, out of cooling off period and 'until Friday', but you are perfectly fine to use your sim with any phone that is not locked to a different network.0

In the past 5 years I have probably used my network supplied phone for around a month in total. I tend to get the best free phone they offer, sell it and then buy what I want.
Did that last month, free plastic fantastic S3 received and sold in 2 weeks to pay for a sim free iPhone 5.
I have never had a network supplied iPhone (always more expensive as an upgrade), but strangely T-Mobile recognise I have an iPhone. When I dial 150 I get "welcome to iPhone support" so they know, but couldn't care what phone the sim is in, just that you pay your bill.====0 -

really?? because i wouldnt mind selling my iphone 5 and getting the new sony xperia T and id make £100 doing that. the tariff that im on is the iphone 5 tariff that is only £26 per month and isnt available for the xperia.
so maybe i could sell the iphone 5 and buy a sim free xperia T and put my contract sim in it?
would i be foolish in asking o2 in their shop if i can do that?0 -

Why would you break your contract, as long as you pay your line rental and any extras you might use the contract will run as normal.
If you have a iPhone 5, remember you will need a nano sim adapter to use the SIM card in a different phone.====0 -

ive no idea lol, i read somewhere a while ago it was illegal and i think thats stuck in my head.
i got the adapters with the simcard when i got my iPhone.

No, it's never been illegal (unless you bought your phone on hire purchase from Crazy George's).
The networks are all very clear now, your contract is for the SIM card and use of the network. The handset is a totally separate thing.
It's in the networks interest, if you lose or break the handset all the network has to do is send you a new sim to comply with the contract and you still have to pay the monthly line rental, even though you don't have a handset anymore.====0 -
