Toshiba Regza screen problem

I have a 42 inch LCD which for over a year now has had what you could call a watermark (dark stain) down the side of the screen and not always in the same place. Also leaving on any Sky menu for more than a couple of seconds will burn it into the screen and take some time to fade.
Although Toshiba didn't offer any help due to it's age (about 5 years) she did mention that may be possible recourse via the retailer (Currys) under the sale of goods act which goes up to 6 years.
I vaguely recall hearing about this but does anybody have any info on it and how you proceed with any possible claim.

TBH, it possibly isnt worth pursuing.
Under the SoGA you are entitled to a reasonable life on your items and for them to be defect free. In the first 6 months if a fault occurs it is up to the retailer to prove the fault isnt inherent but after that it is up to you to prove that it is. So in short you would need to get an engineers report to say what the cause of the fault is.
After that you evidently need to argue that a mid ranged TV bought in 2007 should have an average life expectancy of more than 5 years.
The final point is that even after you have done all of that then the retailer doesnt have to give you the full value of the purchase as they are entitled to deduct off a value for the use that you have already had out of your TV.
Realistically, assuming your TV was around £500 then its only going to be at most a couple of hundred and possibly just £100 after use is deducted.
Of cause, there is nothing to stop you simply writing, mentioning the sales of good act and see how they react (though DSG arent known for good service) - it could be they simply offer you a discount off a new set from them0 -

I've been following up info similar to the details you've posted as I didn't realise I actually knew someone online who used to work for Currys.
I came to the same conclusion. Anything I might get back is probably not as much as I could save on a new one by shopping around or haggling.
All I need now is enough to buy a new TV (all :rotfl:).0
