    More than fair. Cases where an IP petitions for BR after an IVA has failed are very rare these days, and of course it doesn't automatically follow that creditors petition for BR upon failure either, but IP's can seek the appointment in such cases and indeed are highly likely to be granted it.

    There is an argument to say that there is no such thing as independent advice at all, everyone in the circle can be said to have some sort of financial interest in the volume or outcome of cases, and therefore don't truly pass the test of impartiality. There are degrees within there of course.

    We can debate all day as to whether we as a society should go back to our parents ways, and maybe we should, but we are then told with great authority that the main reason why the country is struggling to pick up is that the banks are not lending. Ok, this is aimed primarily at businesses, but it remains the same argument for individuals as well.

    The news that BR is likely to get a lot more user friendly, and decidedly cheaper, is excellent news from one angle. From the other, it is terrible.

    Another good and interesting post, its getting too friendly by far:)

    Amongst others I like the bit about about volume and case outcomes etc - nice one.

    We will have to wait & see what happens with regard to bankruptcy becoming more user friendly & cheaper etc, I have been around much too long now to count the chickens.

    I was going to put a link up about the above from a 'leading' charitable debt advice organisation, what their view was about this, but I cant seem to find it now - their take was certainly interesting:)

    With all thats going on, rumour has it that the annual MALG conference late in November has the potential to be a little lively this year.

    It was certainly very interesting last year, and I have no reason to doubt that it will be any different this year.

    Last years opening panel Q&A session was most enlightening and highly informative, as was the BBA's view of what line they are/were likely to take on funding issues for advice, amongst other topics.
