    Yes, I know.

    but you specifically referenced DMG61276 and 61255, which are the definitions of being unable/virtually unable to walk.

    I used 61300 and the commissioners decision to highlight a specific part of case law that refers to the affect of pain when walking.

    You seem a little affronted unless I am misreading the way you phrase your post?

    I wasn't posting to point this out to you as yes you know but it was aimed at the OP who may not know where to look. I never knew, at the outset of my claiming DLA, even though I come from a professional background used to having to find 'things' out and very quickly.

    Also, I feel, posters need to have a good read through the guides as disability affects people in subtly differing ways and only the person in question can really read into it and how it applies to them.

    I thought this was the case. I remember reading it a while ago, but the way things are changing you wouldn't know if that descriptor had been scrapped.

    Tell you who I feel sorry for?

    Those who aren't able to keep up to date with all the stuff they need to keep up to date with. Even for those with some energy left can still find it very tiresome. And I have found the so called help available from CAB, etc a bit iffy but guess it depends on the person on offer to help you.

    Personally I've never bothered with CAB. Usually the adviser has too look up the answer to what they've been asked, and I can do that much myself.

    Confussed here. Basically the walking must increase the pain? To be honest Iam questioning whether to even bother to appeal the mobility.

    DLA never wrote out to the physio yet did bother to write out to my Psychiatrist. Why DLA decided to not to write to physio re my back is strange.

    If when walking you experience severe discomfort, then you are considered virtually unable to walk - even if you CAN walk. You may be in pain even when not walking, but for the mobility component of DLA you have to show that you do have severe discomfort when walking.

    I can't see why you shouldn't qualify for it.

    Just like why has DLA decided I don't need ANY care but was on high rate before. Based there decision on a report from a Doc that gives one or two sentences to questions. Then says no to things when it should be yes. My carer needs to look for work and that puts me in a situation.
    I just hope I win the appeal if not will re-apply and re-apply.

    This is because they're all volunteers. I used to do this myself as a trainee part-time volunteer adviser, this was a few years ago now. I got very frustrated, especially when doing it by phone, because I never seemed to be able to get people to accept the facts as I gave them. Yes, there is a database of the information and if it's not on there you probably can't answer their question. Or people think you're a government employee, that the agency is like the JobCentre, which it isn't. One woman spent ages on the phone going round and round the same question, couldn't accept what I was telling her and in the end I said 'I'm sorry, I've got other people waiting, I can't tell you anything different from what I've told you already'. Then I got into trouble for 'being rude to a client'. I went out of there to where DH was waiting to pick me up, snapped at him for no reason and then I thought 'this is it, I can't do this any more'. I've never been back since.
