    is moronic. If you felt I did then I apologise unreservedly.Sillychuckie's statement though was factualy incorrect and misleading to potential claiments.

    My main point though was that if ever the banks are to be stopped abusing
    their exclusive position which is meant to be founded on trust and honesty
    It's gonna take someone who's prepared to put their b******s on the line.

    For me it would'nt be such a big deal but for Tom Brennan it would. And I think he deserves more respect than he's getting from some people here.

    I agree. Ejones works in a bank, and must have some idea of the volume of customers claiming bank charges and also the charges being made and I don't envy her working in a bank with all the unhappy customers there are.

    If this case does go to Court, then a precedent will be set and banks may have to re-think their bank charges for future transactions saving us all some cash in future which would benefit the majority of the population.

    Hopefully it won't ruin his life, but why bother risking it. The FSA will decide in its own time what is or is not lawful.


    Just how bright are you? The FSA or the OFT have no authority whatsover to decide what is lawful. Only a judge can do that which is why this is so important. And of course it will set a precident. If natwest have to disclose their charge costs they can no longer file defences against any claims and will have to hand out refunds like confetti.

    And if he loses he dos'nt risk it for anyone as he's claiming 'exemplary damages' which no one
    claims anyway.

    I am financialy involved in an action against another bank seeking a 'declaration' of their charge costs. There is no financial gain in it if we win but the same applies. I have given a personal guarentee of nearly £100k to meet costs if we lose which enables the case to be brought in the first place. The bigger picture is the issue here and as I can fortunatly afford it, the potential satisfaction of seeing a bank humiliated is worth every penny

    Out of couriosity, whats the name of the Bank you are taking to court?

    I'm retired, so I spose there are always vacancies. And in the great scheme of things it's peanuts compared to what the bank will have to shell out in claims if we win. If we lose I'll sleep soundly in the knowledge I tried. But either way it's gonna be fun and at my time of life I need all the laughs I can get.

    Well.... its an incredibly noble thing to do, using £100,000 of your own money as a guarantee to meet costs when taking action against this bank (dying to know who it is ;) ), with no financial gain for yourself even if you win !!

    Now with £100,000 at my disposal, I could pay off the mortgage, pay off my nieces and nephews student loans, and have a bit left to invest. Ah well....

    Yes but if we win it could mean thousands of people could be significantly
    better off and for the risk, you could'nt buy kind of satisfaction for 1000
    times that amount
