dealer sold me a car with outstanding finance
I bought a used car a month ago from Jason jones auto centre in tewkesbury. Two weeks later they went into administration. I got suspicious and did a full hpi check on the car and it turns out it has an existing finance agreement. I never knew a dealer will commit such fraud.
Now should I contact finance company to ask about this or will that be drawing too much attention to myself ?
Also I paid part of the payment by credit card , can i claim from credit card company according to section 75 ?
I am so stressed that finance company will take the car away and i will lose lot of money. please advice.

Car dealers are dodgy! Just read this forum, there are posts about them every other day. Going into admin a couple of weeks later shows that they were in one hell of a mess. Dealers do dodgy things, if you saw watchdog a week or two back you'd know that. It's anything to get money from you.
As for asking about section 75, i think you need to go and ask a pro or at least look on some proper websites that give proper advice. Asking on internet forums will always result in someone telling you what you want to hear (or not) and its not always correct.
Either way, there is a valuable lesson for you to learn here, ALWAYS do a HPI check before buying a car. You can do them for what.. a fiver.. thats a drink down the pub these days and for the huge financial loss you could suffer if the car is reclaimed, I'd say its money well spent.0 -

I think you should be covered ok. The car dealer was in the wrong and therefore the finance company shouldnt pursue you for ownership of the car - its something they need to take up with the receivers.
Unfortunately it probably does mean a worrying time ahead until its finally sorted, but i would be confident that it will be sorted out in your favour0 -
of course doing an hpi after the event may cause you problems as its now logged to you unless you used aunt fannies credit card?

OP a place of business is now defunct, and you later HPi'd your own car. Those are facts.
What are you concerned about? Have the bailiffs kicked in your door? Are you aware of the lag involved in clearing finance/plates/paperwork in most secondhand cars?
I have no idea how you sleep at night with your real and imagined concerns.0 -
Who is the HPI with? When I bought my car from Quicks it showed up as BMW Finance because that is how they finance their stock. I rang BMW Finance who confirmed what it was and how it all worked.
Pretty much all dealerships do it a similar way.0 -

that's bang out of order. If the dealer knew there was outstanding finance they didn't have title to the vehicle so can't legally pass property (ownership) to the OP. I'd say that was a pretty genuine concern.
OP do you know the name of the finance company? might be worth contacting them.0 -

Food for thought, if I found myself in that situation the creditors would be more than welcome to come round and remove the empty shell that would be left of their car!0

The finance company cannot take the vehicle from you in this instance. There is law in place to protect you as an innocent consumer.
Just continue using the vehicle as before - unless there are any other issues?0
