Same situation...different person

Hi guys (again).
So my OH just told me his step mother is having a sort of same situation as myself.

Lets call her K.

K has 3 children, 2 to a NRP, 1 to her OH.

NRP sees the children 'once in a blue moon', he makes no maintenance contributions. NRP does have a job and K in the past has tried to use CSA for maintenance however in the past NRP quit the job as soon as CSA contacted him.

NRP is now saying he has sought legal advice and his lawyer has said that K must pay the travel costs for NRP to pick up and drop off the children. (Both live in England, NRP lives roughly 34 miles from K)

Any solidity to this?

Sounds like another one with a drinking buddy who thinks he knows a bit.

Only a court can order the RP to pay costs to the NRP for travel (I have the t-shirt LOL). The CSA can reduce payments by a 'variation' if the travel costs are excessive but, and here's the clincher, if he ain't paying anything there's nothing to reduce! 34 miles is not excessive.

So let him quit his job, he wont be entitled to benefits for a certain amount of time but once he does get them she should get something from his benefits automaticaly its not much but it might be a kick up the bum that says they will get something dispite what he does.

Yes, we were ordered to pay travel costs for the NRP including hotel costs! Which is why I know it's highly unusual.

BUT... ONLY A COURT CAN ORDER THIS

This is the kind of thing that is usually agreed between the parents (although it’s difficult when things aren’t amicable).

IF the NRP pays child maintenance via the Child Support Agency they can apply for a variation if they have excessive travel costs. But from what I understand the variation is nowhere near the true cost incurred by the NRP.

To be honest there’s no right or wrong. A lot of the time the NRP ends up paying the costs of travel. I’m an NRPP and travel is shared between my Husband (NRP) and his ex (PWC).
