    I understand that, but that wasn't my question to ppc_guy. I want to know if after a rejection of an appeal to the parking company, and the person wanting to go to popla whether the ppc will have an option to drop the claim rather than pay the £32 to go to popla?

    AIUI, the appeal rejection letter from the PPC must contain the details of how to appeal to POPLA, which can be done online, as soon as the letter is received.

    So if they don't want it to go to POPLA, they may as well grant the appeal and save the £32.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years.     Yes, same person I believe. Last week that person tried to bat back one of my complaints (I made about 10 separate complaints about different firms' websites) by saying the website I was reporting 'clearly showed' the firm worked for Councils as well as in their private capacity.

    I nearly fell off my chair because the firm in question most certainly DOES NOT and that was one of the points I was making, that the website was horrendously misleading and said the rk was liable. If the DVLA can fall for such a load of tosh (which to me was OBVIOUS in lots of ways) then what hope is there?

    So of course the ball is firmly back in the DVLA's court over that one (along with the other 8 or 9 I complained about; all AOS members).

    They are there to milk as much from the public as you can otherwise you would be out of business.
    They suffer no loss with someone over staying a few minutes but try and scam a sum of money out of people who can ill afford it...How can i enter a contract that i do not know the full extent of or even agree to...There is no loss to them as a company and this has been ruled on in the court.. They are a snakes...

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    There will be one (allegedly) in place on 1st October called POPLA if it passed you by

    I've been in 'thick' mode for most of today, so let's see if toronto 'brain of an amoeba' boy has got this right;

    1. a ticket is issued. a PPC appeal is made.

    FAIL.

    2. a POPLA appeal is made.

    FAIL.

    the POPLA adjudication is binding apon the PPC but not the driver/RK.

    driver/RK now sits back and refuses point-blank to pay.

    the PPC will have to think long and hard when it receives the driver's appeal. should they allow it and avoid the possibility of an adverse POPLA ruling, which would leave them over £30 lighter? or should they tough it out, hope for a favourable POPLA ruling and then run off to county court, squealing 'look your honour! POPLA says we were right all along. show us the money!' ?

    there are dolts, half-brains and blithering idiots online but today, compared to me, they all seem like rocket scientists.

    It makes no difference the adverse popla appeal, they all cost £32 no matter if its win or lose. If it went to court after a refusal to pay, you could argue yes it lost at appeal you honour, but look at the process here, there is no ability to appeal on that I didn't see the signs, or the fact that its an unfair penalty, or that my P&D ticket was on the left hand side of the dash instead of the right etc etc

    can the PPC add the £32.40 to 'the oustanding amount owed'?and the court would disallow any attempt by the PPC to recover the £32.40 from the defendant?

    I doubt it, they are different processes. But let's face it they can trump up other charges instead, for example the admin costs will be £32 more than Pre popla , they will try and offload it to the victim somehow or another, just wait now that they will trump up their charges from circa £60 to £100 because the bpa has given them the go ahead on that level. As HO87 says the greatest coincidence in history is about to happen.
