Thanks, but personally I don't see the point in contacting the DVLA because the rules are basically the same. The car must be used for the benefit of the disabled person, whether they are in the car or not.

I don't think they are. As I understand it, the DVLA are much stricter. If you have the free tax disc, the car can only be used for the disabled person's direct needs.

Replies to other threads on here have said that Mobility has okayed the car being used for purposes that only indirectly benefit the disabled person, such as a parent going to work or a family member driving from their home to the disabled person's home. In these cases, the car would need an ordinary tax disc, not the disabled one.
  • This morning I drove his motability car and took DH to his Alzheimers club, then went to the GP to collect his prescription. Then I paid our joint credit card bill, posted a birthday card to one of our DGDs, then collected some food for our dog.

But then I sinned and walked along to Costas, where I met a friend for a coffee, and just drunk it all myself! If I'm charged with law-breaking or fraud, well so be it, cos I cannot work out what I'm supposed to do.

it so easy to ignore things that you dont want to hear, people choose to justify their actions in a way that suits them.

My God the chance of a free car must be such a draw when you dont have a car but it dosnt mean that you can ignore the law and the DVLA will never, ever give you permission in writing to use a motability vehicle to transport your kids to school or any other normal family activity.

Once the carer has the car they use it as their family car, to them it would be mad to do anything else, they have the car and the keys so what would it harm to take the kids to the seaside etc. in it?

Why trying to pretend? The reality is that a large number of named users would still have bought a car for their own needs if they couldn't used the motability for it. Of course you can straight how you are using the car for the disabled person to how far as you wish to justify that it isn't used for their own benefits in anyway, but the reality is that as much as it can be streched one side, it can also be straight the other. Can you trully say that if it wasn't for the motability, you would happily make due without a car?

On another point if say DLA is revoked under new assessment rulings how quickly is the car expected to be returned and as ours was a £800 deposit do we get x % of that back? And lastly this could be catastrophic for Motability in lost revenues and cars well under lease agreements coming back to them a nightmare for them to I'm sure
Motability have confirmed that if you lose high rate then car goes back within a month. You may have a option of buying the car off them. It will affect Motability big time when PIP happens, up to 150,000 cars may go back early.
  • Whole scheme should be scrapped, There are now so many grey Nissan qashqai's with disabled tax running around here you would think they where breeding!
You sound like a Daily Mail reader who believes everything they print. Motability helps thousands of disabled people be mobile. Yes, there is some fraud, but not as high as some believe. The scheme should continue but it will face a huge challange when PIP arrives. I expect the scheme to change hugely 3 or 4 years down the line.
