Didn't know I should call my own tow truck and remove clamp.
I got a clamp from citywatch in a private car park, I think its owned by a landlord of some flats but its behind a hospital clinic who I was visiting to collect something I left behind from a previous visit.
ThriftHall Behind Waltham Abbey Tescos
I was charge £455 + 5% total 477.75 on a credit card.
My intention is to write a letter asking for money back to both landlord if I can get details and the PCN Co City Watch
If they don't refund I will take them to Court.
I need to know what to say, and what my grounds are, pictures of tickets sign cannot attached how as I'm new to the forum.

You need to post on pepipoo for this http://forums.pepipoo.com/index.php?showforum=60
You won't get any money back from the clampers as they will be gone. You first move is to do a charge back as you used a credit card. Don't let the phone monkey on the phone put you. So get over to pepipoo and phone your credit card tomoz to get the charge back rolling.
If it fails then sue all parties.
Don't bother writing to clampers or a begging letter to landlords. You will prepare a letter befire action. Again pepipoo people will help you do the letter.
Which credit card company was it?For everthing else there's mastercard.
For clampers there's Barclaycard.0 -

I think you need to wait for the payment to go through, then raise the dispute, say you paid under extreme duress, and demand that they return your money. Can you tell us if you paid by machine entering your pin, or by card imprint or over the phone?Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
They said they will only accept payment by card with pin, or cash, no other payment method was allowed.
I said I don't know my pin for 10 mins I argued to sign instead,
In the end I paid by card using my pin, they were very insistent and said I would be towed if I don't pay soon.
I got very scared and got the impression the payment was only the beginning I did feel under duress there were two very big men over 6ft and you could see they both body built.

It's open season. With clamping being banned on Monday and a lot of clamping companies then dissolving, it's make hay time.0

Well at least you paid by Barclaycard, they seem to be one of the good ones when it comes to chargebacksFor everthing else there's mastercard.

I live in a modern street where, as is often the case, there are off-road parking spaces allocated to specific houses, as well as for visitors' use.
Some stupid woman parked in one of my neighbour's allocated spaces a few months ago to deliver her child to the school round the corner, and was clamped before she got back to her car.
However, what is not obvious from the road layout is that the spaces where my cars are parked are part of my property. I'm just itching for an over-enthusiastic clampit in a final frenzy of extortion to clamp my cars over this weekend! My angle grinder is straining at its leash...Je suis Charlie.0 -
Research today uncovers its private landlords of a building next to the spaces, not the NHS clinic who are responsible for spaces, and might have been the ones to authorise the clampers.
Photos I've taken reveal only the one A4 size sign well above eye level, no sign at the entrance to the car park or anywhere else.
I plan to write asking for my money back, before excalating to a court claim. I will go for land registry to get landlord address details. Mean while pushing barclaycard for a refund.
what grounds should I go for ?
Extortion, under duress, pressure sales tactics ( we take your car if you don't pay, fee will go up etc...) Unclear signs, not showing ID when I arrived, in photos of them no ID is on display.
Thanks for your further advice0 -
You don't write to ask for your money bk, waste of time. You do an NBA to all parties giving them 14 days or you will sue. Ask on pepipoo for NBA wordingFor everthing else there's mastercard.

I did ask for NBA Wording
I am thinking of writing to Barclaycard as they will be responsible for returning the money from my card via chargeback.
and sending a letter to owner of Thrifthall when I find out - where can I get the details, landregistry want £19.95 to find out
and also to the PCN issuer citywatch
here are the facts
I demand full and complete refund of the money paid £477.75
You have 7 days to return this to me, or I will proceed with court action.
Extortion charging this for parking for less than 2 mins
Under Duress saying I will have to pay, they will take the car away if I do not hurry up.
Not adequate signage on entrance, only one sign and too high to read.
Breaking the SIA Governing Rules
as part of the rules governing clamping decided by the SIA, clampers may only clamp the driver side front wheel of a vehicle. clamping of any other wheel is illegal, and must be removed immediately without release charge. (
my passenger side rear wheel clamped, photo to prove it)
Not wearing ID, photos to prove it. (not aware at the time this was necessary)0
