An update from me for those interested/searching for similar issues
T-Mobile have apologised and said they will refund the amount -I explained that they weren't to do that but having spoken to 3 seperate americans at their call centre they really aren't the brightest bunch so face more ballache having to deal with either the bank or T-Mobile again.
The phone staff just don't understand the concept of my bank getting in touch to claim the money and their complain email form is bouncing, their twitter account not getting back in touch and their facebook page much the same. I spoke to my bank to say I had zero faith in the process going smoothly but they told me not to worry and they will sort it all - I'm not sure how they can with no details of the dispute etc?
Halfway there but nowhere near over yet0
