  • Hi, did the other item list in the description that it was damaged, or could you see it from the picture? If so, you could try phoning ebay and trying to explain your predicament to them. I'm not sure how much ebay can / will help you though. Good luck.

    yes, the item which they purchased in July clearly states damaged and the photographs pretty much match the damage which they are claiming has happened to my item.

    I have just come off ebay chat and despite the buyers possible fraudulent activity if they return the item I would still have to refund them but they are going to take appropriate action against them, whatever that means ? I am pretty upset that as a seller I am afforded no protection. I feel like messaging the buyer and letting them know that I am aware that the damage is pretty similar to the damage of the item they bought a few months ago, I guess I would probably get into trouble for some sort of threatening message though :(

    I don't know what you have said so far.

    But as they are (possibly) brazen, why not be so yourself.

    Tell them there is no problem if they return everything including the packaging and that you will check the item yourself. Perhaps let them know it was marked for insurance purposes ;)

    That's a really good idea and I am so tempted to do that.

    I basically expressed my shock at how the level of damage could have occurred given the amount of packaging involved. I queried why they didn't contact me immediately and asked about whether the packaging showed any sign of damage etc. I had looked at their purchase history and saw that they seemed to be a collector of the item they had purchased from myself and it was only when I clicked into the description of their most recent purchase of said item I saw the damage which is pretty much consistent with the photo they have sent me ?!!!

    I just really don't want to be out of pocket to the amount involved :(

    So you can almost prove that they bought a similar item damaged, then bought your mint item and Ebay state that they are within their rights to send you the damaged one and keep the mint one.

    You end up with no payment, and somebody else's damaged item?

    That is a disgrace.

    It is a disgrace IF it were the case. Unfortunately we will never know. The only person who will, is the buyer.

    Dear Buyer,

    I have been continuing to look into this issue to resolve it, and I wanted to check that you weren't confusing the brand new item you bought off me with an identical, but damaged item that you bought off another seller in July. The damage you are describing seems to match the description & photos on item number XXXXX. If this is the case, let me know, and I'll contact ebay to close the case.

    Thanks for this, I think it will come in very useful when I message them. I also think I may mention security markings in an attempt to call their bluff.

    Had they contacted me immediately after receiving the item I probably wouldn't have had any suspicions but given the period of time which has lapsed and the price of the item I couldn't help but suspect something was not right.

    Prior to purchase they sent several questions to confirm the condition of the item and I even apologised regarding the amount of packaging I used as I did not want to risk any damage in transit yet they have contacted me with images of an item which is more or less identical to a damaged item they bought a few months ago. The damaged item listing actually contained a description of what had happened to cause the damage and clearly you can see that is the case. I don't believe what they are claiming has happened to my item has happened in transit (although I don't believe the photos I have received are of the item I sold) :mad:
