It is up to the car driver pulling across both lanes to make sure that both lanes are clear before pulling out. If they are unsure, then they don't pull out, it's as simple as that.
At the time of the collision the car driver had only pulled across one lane... a lane of stationary cars!0 -
if a reasonable person takes the relevant look at the relevant point in the manoeuvre and judges that he has enough time and space to make the manoeuvre taking into account the hazard from filtering bikers, he has done what most people would accept is reasonable.0

You don't know that he failed to check the lane he was crossing.0

I'm not going to defend the m/cyclist's speed, it was a bit fast IMO. But surely the simple fact is that the Passat should have been edging out EXPECTING a bike OR a car to be driving down there at anything up to 30mph.0

Why? That section of road is one lane in each direction, and the lane to the Passat's right was stopped.0

Well Brat obviously thinks it is reasonable to pull out in front of motorcyclists without looking.0 -

If he didn't, then he must have deliberately taken out the motorcyclist.0 -

Exactly. And if he had done, then there would have been no collision.0 -
