Hiya, can anyone help with the following?
This is a true story -
My ex-husband left in 2002, a credit card was sent to my address, my home he left where our two children also lived. This card was opened by mistake and I cut the card in half, I called the CC company direct and explained he longer lives here, please please do not give him credit, he has a problem! and this is one of the reasons he has left, during the next few months the credit card company contacted me stating they sent the card to him at his girlfriends address, and since then there has been no contact with him (just as I had explained) they found my ex on the land registry and attached the debt to my home!!! I talked at length with them and I contact a solicitor who was far too expensive per hour he said as I had a court judgement prior to this charge, the credit card company could only look at my ex's % of the home.
How can this happen? I begged the company not to issue the card as he my ex did not live here anymore.
The debt has since been settled by a loan on my behalf £16k
any suggestions??

First of all if the debt is his then it is his alone.
Is the property owed by both of you or just you?
Is he on any mortgage on the property?
If the house is yours alone then the credit card can put a charge on it but it won't do any good as he has no asset there.
If you have no plans to move it will not affect you.
However I would write to the company asking why they are putting this charge on your property.

far too many people dont deal with this on separation
you have a charging order on your house that you have never recieved any notice of so that you could defend the case ?
the credit card debt was ccj on your house ? and you never recieved a court letter to defend ?
in 2002 did you not get your husband to sign a deed of trust and get him removed off the mortgage and off the land registry ?
did you contact your lender on mortgage ?
did you not get your husband removed off the electoral roll when he left ?
did you do notice of dissasociation of the 3 CRA's ? to get him so he his not finincially linked to you ?
sorry to ask all them but they are some of the steps that should of been done
if you can prove that you never recieved the court letters from the court on the charging order and ccj then you could go back to court and defend them you will need professional advice on how to do this
if you got the letters to your address from the court and took no action your pretty shafted im afraid
