    Sounds like the solicitor forgot to take care of a number of things if you ask me!

    If the solicitor messed up, you should consider a complaint via the Legal Ombudsman.

    Forgetting to contact a witness doesn't sound particularly competent.

    The original hearing did not take place, so this letter you have received from the debt collector saying you have a ccj against you may be a tactic!

    To get a ccj, you would have to have been involved in a new court case and received a number of docs from the court (ie not just a single letter from a debt collector).

    In any case, even if it is true, you should get back to your insurer (not their solicitor), and demand that they sort this out and if there is a ccj in existence against you over a debt that they should have paid that they now arrange for court action to get the ccj set aside. (This is something that their legal department will know all about)

    I would get down to your local court monday with the details of the CCJ and have an application made to set it aside

    This will stop the baliffs calling, in any case i would keep the house locked and park your car at your friends, until the above is done.

    There is a fee to pay but its worth it
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    Getting it set aside isn't a simple matter of popping in to your court and paying a fee!

    The op should leave this to the insurer to sort it for him.

    Just a quick update.

    My mother contacted the solicitor today who has spoken to the bailiff and advised him that my mother has had no contact from anyone and that it is the fault of the insurance company for not paying out quick enough, the bailiff has agreed to give my mother another week to sort things out.

    My mother also spoke to Sheilas Wheels who have advised her that this would appear to be dirty tricks by the other drivers solicitor to try and speed up the payout.

    There must be someone we can complain to, we also need to try and get the CCJ removed.

    Are you sure there has been another court case?

    You don't normally get informed about a ccj against you by a debt collector!
  • The letter she received was from a debt counselling service who said they had been advised that she had received a ccj.
