Insurance claim - warrant issued

I am hoping I have posted this in the right section.
My mother was involved in an accident where it was settled at county court (before going into the court room) as 50/50 fault.
The solicitor didn't know much about the case and the witnesses on my mothers side hadn't even been contacted to attend, so we thought we best go 50/50 when it was offered.
The solicitor went on to say that this was the end of the matter.

Now five months on my mother has received two letters, one from a debt counselling agency saying that they have been advised that she has a CCJ and the second is a notice of a bailiffs warrant if she doesn't pay over £1000 to the other driver.

Is this right?, should the insurance companies not be sorting this?

I hope someone is able to help and offer some peace of mind.

  • The insurance should be the first port of call. I'd also make contact with the court and the bailiff. He they attend your mother is paying for their visit.

  • Does your mother have legal cover on the insurance? If so, use it.
  • Unfortunately she did not take out the optional legal expenses cover.

    I have called the barrister and left a message on the answerphone.
    I have called the insurer who said to call the solicitor.
    I have called the solicitor who is not in until Monday.

    The warrant is for Wednesday!

  • How was the damage on your mothers car sorted?
  • The car was written off.

    My mother only went 50/50 because her solicitor didn't even remember to contact her witness. So when the other party had a witness at the court it seemed the safer option.

  • Yes she received a cheque from the insurers.
