    The DWP is entitled to any costs they incurred but the fault insurer pays these as a disbursement from your solicitors. This is not paid from any compensation you receive. The DWP would have sent a similar letter to the solicitors acting for you.

    You (the solicitors act for you) only have 3 years to reclaim any costs so you should act quick. However, if the matter was settled in full and final settlement with consent order or any document filed at court the other party's insurer has a right to refuse any further payments.

    Did you bother to look at that website I linked to earlier?

    There are contact numbers on that website, but I am sure there will be contact numbers on that letter which you appear to have not read yet.

    I had already looked at the website before creating the post.

    Anyways an update....It relates to an accident where a guy ran into the side of my car, I did not want to claim for personal injury, the letter is to perform checks on if any SSB were claimed as a consequence of the incident. Now since that time I have been hounded by the ambulance chasers to claim, so I will advise the DWP that I am not persuing a claim and was not in receipt of any benefits.

    That's a bit odd, as a claim has to be registered with the CRU for them to know about the accident in the first place. If you are not pursuing a claim and never have, how did they get your details?

    From the insurance company I guess? I had a call a few weeks back from that 0203 number with some aggresive guy telling me there is a 4 figure sum set aside, I kept persisting that I didnt want to make a claim, they knew my name address vehicle reg and everything, told him I self medicated and was rehabilitated in a couple of weeks, he was trying to enourage me that it took longer? So I reckon they just went ahead :eek:

    That would be an ambulance chaser talking about compensation - not benefits.

    The DWP is just interested in benefits and they should already know that you did not claim any benefits, because their records should tell them you did/did not.

    I think the question for the OP is did you get any benefits at the time, for the injury/sickness, like IB/ESA/DLA or IIDB or even any other benefits like JSA/IS


    What the DWP can do is pay you an income based benefit, and if you have more than £6000 it should be declared to DWP and will affect your IB based benefits. If you do not inform them, then they can do a fraud investigation. Your injury compensation payments will not affect your IB based benefits for the first year, and you have that year, to put the money into a trustfund, after which time, if the money is in a trust, it will not affect your benefits. More than a year and the money which is not in a trust becomes "capital" which can affect the benefits.

    This post contains errors, the DWP can and do take a fair chunk of the compensation awarded to car crash victims to recoup any benefits claimed after an accident and it includes contribution based benefits not just income based benefits and even DLA(which I personally think is wrong as its awarded to help with the extra expenses caused by disability and you are still having the extra expenses) if the accident caused disability, this money is taken BEFORE the claimant gets a penny and the insurors should pay it but there are many cases where mistakes are made and the claimant gets stuck with the bill.

    I paid back a five figure sum even though I only got contributions based IVB and DLA.

    Odds are the copy you have received is just sent to you for information purposes. Your solicitor gets a copy, as do the insurers of the other party.

    Usually these will just say NIL.

    The only time any money would be clawed from your compensation claim is if there were benefits claimed as a result of the injuries you sustained and you claim for lost earnings too. The insurer would simply offset the benefits received from the loss of earnings claim.

    Example, the CRU certificate says you received £500 in benefit. Yet you are also claiming say £1000 lost earnings for the time you were off work and not paid.
    The outcome would be you get £500 in your pocket, net of the £500 already received in benefits.

    Money paid out in any benefits cannot be offset against the actual compensation for pain & suffering.

    If someone has submitted a claim without your consent, that is a VERY serious situation. Do you know the name or details of the bandits that were cold calling you?

    The CRU certificate may have the name and claim ref number of the compensator (insurer who is being claimed against). Find a way of contacting that insurer and (assuming you have no interest in making an injury compensation claim) ask them if an injury claim has been submitted to them.

    A formal investigation will then be launched by the insurer.

    Scum pulling stunts like this should be investigated and shut down quick sharp.
