I'm not at home at the mo, but my bro says a letter from the dwp compensation recovery unit has landed at home. What's all that about? Should I be worried? I have checked the website but it's not clear, a few years back some driver ran up the back of my car, case closed from 3 years odd ago, I don't recall anybody ever mentioning this unit, what is it exactly , anybody know?

    The DWP like to claw-back the costs of any benefits such as SSP and hospital treatment costs from any compensation you may get.

    They tried it on with me after I had an industrial injuries pay-out. I asked them to prove that I had received any benefits in relation to my injury. They couldn't and cleared-off.

    Doesn't sound right to me, compensation for injuries awarded by a court or insurer is yours to keep.

    The DWP can't charge you for hospital treatment or SSP and can't take money out of your compensation award against any benefits you received at the time.

    I think the question for the OP is did you get any benefits at the time, for the injury/sickness, like IB/ESA/DLA or IIDB or even any other benefits like JSA/IS


    What the DWP can do is pay you an income based benefit, and if you have more than £6000 it should be declared to DWP and will affect your IB based benefits. If you do not inform them, then they can do a fraud investigation. Your injury compensation payments will not affect your IB based benefits for the first year, and you have that year, to put the money into a trustfund, after which time, if the money is in a trust, it will not affect your benefits. More than a year and the money which is not in a trust becomes "capital" which can affect the benefits.

    Did you get treatment on the NHS for injuries from the accident? They can also recover those from you, the theory being that what they get from you will be / has been paid by the other guy's insurers and that the taxpayer (through the NHS) shouldn't be worse off because of his driving any more than you should be.

    Please note, I don't personally agree with this (especially seeing as those costs probably weren't included in your claim at the time) but that's the thinking behind it.

    Ok so did you win on the accident? i.e. whose fault was it? Did your insurer get recovery of damaages from the other guy and you kept your NCD?

    If they are recovering NHS costs (I would have thought the NHS would be doing that not the DWP) then just pass the letter onto your insurer at the time.

    It was a no blame (for me ) claim, surely that moeny should be coming from the 3rd party insurers?

    Yes, your insurer will claim it from the 3rd party, but it aint your problem, it's your insurers (at the time) problem. Don't give it a second thought just give it to your insurers (at the time).

    It may even tell you what it is all about.
    No-one here can guess the content of that letter, can they?
    But my money is on them wanting money from you, or your insurers, to cover hospital and/or ambulance services.

    Did you bother to look at that website I linked to earlier?

    There are contact numbers on that website, but I am sure there will be contact numbers on that letter which you appear to have not read yet.
