Sent ebay an email kicking off about it all. Since my dispute hasnt been replied to by the seller then I cant escalate the claim.
Heres my very helpful reply from ebay

Thank you for contacting us regarding the item purchased from "jumpingjackflash07". Please allow me the opportunity to assist you.
I understand that you have not received your item as of this time and that you're worried about the status of your "Item Not Received"
dispute filed on eBay. I realise that you want to know where you stand in a situation like this.
First of all, I regret to say that you won't be able to file an eBay Standard Purchase Protection Programme claim because you paid less than
£15 for the item exclusive of the postage cost. For more information about eligibility for the Standard Purchase Protection Programme, please copy this link into a new browser window:
    http://pages.ebay.co.uk/help/confidence/sppp-eligibility.html
Contact your bank or credit card company. They may still be able to stop the payment, or offer purchase protection.
Retain any emails you exchanged with "jumpingjackflash07". The police may need them in order to investigate further.
Should you want to take this matter further, you can either contact the police or pursue a claim through a civil court.
eBay will gladly help the police with their investigations if needed.
Please ask the investigating officer to email us by clicking the "report information to eBay" link on the following page:
    http://pages.ebay.co.uk/help/tp/isgw-fraud-ebays-role.html
If you wish to pursue this as a civil matter, you or your solicitor can contact us for information at the following address:
    eBay Europe S.à r.l.
    Attn: eBay.co.uk Legal
    15 rue Notre Dame
    L-2240 Luxembourg
Your complaint has been noted and, if appropriate, we will take action against the seller to ensure eBay remains a fun, safe place to shop.
However, as it's important that eBay maintains member privacy, we can't share details of the action we take.
I realise this may not be the answer you'd hoped for. I sincerely hope your eBay purchases run more smoothly in the future.

So basically, sod off we arent bothered!!! Cant see me going to court for 5.98!!

Having dealt with ebay when I have been defrauded at least twice in the past and got no support from them, I can believe it.

My favourite was when I realised that the seller of vouchers wasn't going to send them (and all the electrical items others bought from him) as I couldn't contact the seller with their false phone number.

I emailed them and waited a day for the response, 'call the seller'. :rolleyes2

Still, they like pulling my auctions for what seems any silly reason....
