  • Ok so I posted the letter they received it Saturday. Sent them an email confirming I know they received it.

No reply as of yet and probably a fat chance I will receive anything at all.

At the end of the 14 days what's the next step?

Do I go back to consumer advice? Do I go small claims court?

    Thanks in advance

  • What did you say in your letter? Did you threaten them with small claims ?

That would be your next step (it's easy).

I have threatened them with small claims court, and that will I guess be my next step. I just want to know if there is another option before I have to fork out money, If I win the small claim do they have to pay my fees aswell?

    Sounds good.

Guess that will be my next step. This seems an awful lot of messing for £520.

    Damn them

  • Yep, shysters.

I'd issue small claims for anything over £100 so £500 is certainly in the "well worth it" territory.

The cost of the claim is automatically added if I remember correctly.

OK well they have till Saturday till respond, failing that I shall be going through the small claims court.

How long does this process normally take, and what's the situation if she comes to me after receiving the summons and says she will refund?

    LATEST UPDATE

Finally got a response from the store but not the one I was looking for.

They received an signed for the letter on the 22nd September, the letter stated they had till the 6th before I took proceedings further. Yesterday, I get an email saying that due to the owner being away no one could deal with this until the week commencing the 8th?

What do I do? Plough on as intended and raise the small claim on the 6th, or should I allow them till next week to respond? Why is there not someone else who can make decisions while shes away, or why do they not have contact if no one else is trusted to make decisions?

This is getting frustrating beyond belief now and I dont really want to have to wait longer than required to get this sorted.

    Any advice?

It looks to me like they are messing you about, they have had a fair while to let you know the owner was away and they wait untill the malst minute. I don't believe that the owner is totally out of contact and hasn't left anyone in charge, or that she hasn't mentioned any of this to the staff to expect a letter. I would plough on xx
