HI all,

Our car engine went 6 months ago and we could only afford a recon engine at a cost of £400

The head gasket has now gone on it and as its only been 6 months for that price is there any not fit for purpose or any rights we can use?

A new engine is gonna cost £600+vat+labour which we dont have

  • 6 months is the average time scale in wich after this YOU have to prove the fault was there with the engine upon purchase. if you purchased from a private indevidual then sorry you have to foot the bill.

why is a headgasket failure requiring a new engine. it doesnt there are head gasket kits out there for many manufacturers cars.

what car are we talking about.

If it was bought as a re-con, what warranty came with it?
  • Can't see it being a recon for that price, more like a good second hand unit from the breakers.

Does sound like a 2nd hand lump at that price. IF it was a recon it would usually have a warranty of some sort and servicing guidelines.

What happened exactly? Water leaks? Overheating? Power loss?

What tests have you had done?

At that price it definitely isn't reconditioned, probably straight from a scrappy. What warranty is on the receipt, likely 14-28 days with provisos that timing belt and pulleys, thermostat and other service items are replaced.
Time to reassess the whole car and judge if its worth fixing.

What's the car? Might be better off scrapping it, taking the tax back and the scrap money and taking an punt on another one unless it is in exceptionally good nick bar the engine.

    5t.
What if there was no such thing as a rhetorical question?
  • Unfortunately, you have no rights. The price you paid would have been for a 2nd hand engine, and as such is deemed as used. there are no warranties applied or given unless stated at point of purchase. The term "Sold as Seen" usually describes a 2nd hand car.... this term only "really" applies when a car is sold by a member of the public in a private sale (not from a dealers - registered or forecourt) or if the car is sold for an amount of less than £1000. (and is thereby subject to immediate depreciation)

Out of interest, where did you get the 'recon' engine from?

The sale of goods act also applies to second hand goods.
