APCOA at Luton airport and Roxburghe Debt Collectors

My wife was going round the roundabout coming out of Luton Airport when she spotted me and I jumped in the car. 'Parking Enforcement Notice' arrives whilst we are out of the country, sent £40 on return. Then we get threatening letters from Roxburghe Debt Collectors threatening court action if we don't pay them £131. Rang APCOA who admitted they had the cheque, would now cash it and cancel the debt collector.

Simples. If they haven't cashed the cheque, call your bank to stop it, and ignore everything else they send you.Je suis Charlie.0

I am afraid you have fallen for their scam and wasted that £40. In fact you didn't owe them a penny because they can only claim for the actual loss suffered by the landowner. From now on just ignore them, they won't take you to court and your credit record won't be damaged.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

Yes - this is just a scam and Roxburghe are powerless to do anything other than send you threatening junkmail. Cancel that cheque fast and the browse the letter chain thread to see what rubbish to expect from them and then some of the other APCOA threads for plenty of examples of the scam.0

Seconded! Jump on this and cancel the cheque NOW, before it gets presented to you bank. Then ignore the begging letters.0

Cancel the cheque and email them to let them know you have done so.
Dear APCOA
Please be advised that the £40 cheque you have received for PCN 12345 has been cancelled and it should not be cashed.
I refer you to Excel Parking Ltd v Greveson, where it was ruled that a cancelled cheque had not been dishonoured due to there being a failure of consideration."0 -
I have received a number of letters from APCOA and also Roxburghe. Although we had sold the car in question they are insiting we were the owners at the time, which we were not. We have today received another letter in which they are saying they will apply for a Norwich Pharmacal Order. Thei is after we have reaffirmed that we were not the owners at this time. We had sold the car some two/three weeks before this parking event at Luton Airport. We do not have the new buyers details because we sent these off to the DVLA. I am not fussed about the NPO persay as we have nothing to hide but it is getting very, very stressful. We have proof that we were selling it (ebay invoice) and that we cancelled our insurance (change of insurance certificate for our newer car) but thats about it. Any advice please from a rather stressed and harrased person (strangely in Norwich!)0

A Norwich Pharmacal Order cannot be used in the small claims track, and it costs a fortune to get one which you are NOT liable for. Just ignore Roxburghe and their fake solicitors Graham White who will write to you next with their legal poppycock. No need to get stressed with this.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

Write a Letter Before Action to Roxburghe and the Parking company telling them to cease and desist because you have already told them that you were not the car owner at that time. This continued harassment is causing you serious distress and this is your final warning to them that if they contact you again at all, then without further notice you will sue them for damages {of, say £500, state a figure in the hundreds}.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's only stressing you because you are letting it. Either fight back as CM suggests, or ignore the entire scam. A few letters in the post can't hurt you whatever they threaten, it's all just bluff and bluster.Je suis Charlie.0

If your going to fight it out, then dont forget to factor the land owner/car park owner into things as they are liable for the actions of their agents, in this case its Luton airport, APCOA, and Roxburgh.
while your at it a complaint t the office of fair trading about roxburgh may come in useful, as from what i understand they are currently under investigation by the OFT who are minded to revoke their licence.From the Plain Language Commission:
