    Tell them to do one and to get off your property, ie stop them completing the job.

    They need to get a design done for a suitable scaffold, you DO NOT have to demolish your property for their benefit, its up to them to get a safe working solution. This sounds like they are really trying it on.

    I would now as a point of principle notify the HSE as without kickboards the scaffold is unuseable.

    They are penny pinching big time.

    Withdraw your permission (in writing to all parties explaining why) for them to enter your property either by walking your side of the boundary or by being on the scaffolding which is over your property both of which will constitute trespass once your permission has been withdrawn and will be dealt with as such.

    The work will grind to a halt. Then they have to come crawling back to you in supplication.

    You do not have to grant them access. They only have recourse to Access To Neighbouring Property legislation if you have unreasonably witheld permission for them to access your property for the purposes of maintenance of an existing structure. You have been entirely reasonable with them so far so they can't use it and they are being entirely unreasonable in return. Even if they did try and use it it wiull knock a serious hole in the project programme whilst they pursue this avenue. They can't afford that.

    This is going to sound awfully sexist, and I really don't mean it that way, but I'd consider two things:

    1. Write the letter as above and deliver it tonight; AND
    2. Get your OH to go into work late tomorrow morning so that he can speak to the scaffolders, as they clearly don't give a monkeys what you think and are prepared to walk all over your protestations.

    Do you have legal cover on your house insurance? Might be worth contacting them if they are open.
  • i can't believe they are trying this on no wonder your hubby went through the roof, there is no way you have to let them put anything on your property let alone go through your shed they really are taking the p1ss tell them to sod off, yes that is my polite answer to you it would be slightly more graphic to the builders/scaffolders

    The stupid stupid thing is that as an engineer, I deal with awkward confrontations about structural issues frequently at work! Not sure why I can't handle this at home!

    Anyway, we've done as you've suggested and OH is going to talk to the builder this morning and is buying and fitting a padlock to our back gate to prevent any more access without our say so.

    We do have legal cover, will look into that.

    I fear that we now have no option but to end up on bad terms... Hubby also wants to insist on seeing proof of the scaffolders public liability insurance - we suspect he doesn't have any - is this reasonable?

    If they are going to abuse your good nature , then being on bad relations with them will probably be a good thing. however i think you need to give the scaffolders access to remove their property

  • i don't think you are being un-reasonable at all, they are the ones trying to bully you, they have gone back on their promises with regard to netting & kickboards so stick by your guns, yes you will have to let them remove the scaffolding but you don't have to let them put any additional in your garden or allow them access unless it is to remove.
    I'm only here while I wait for Corrie to start.

    I would get myself a couple of bricks from the site and say they fell into my garden causing damage to either myself or my property then claim against them
