Nokia voiding my warranty

I sent my nokia n8 off to repair because the headphone jack had never worked properly ever since i bought the phone back in aprill 2011 and the battery was not holding charge. Nokia then only replaced the battery despite me stating to them it had 2 faults. After a day of using the phone with the replaced battery in it, the battery once again did not hold charge. So once again I had to send it off for repair, this time making sure they had both faults recorded down so that both would get repaired. It was 3 days later when I receieved a phonecall from nokia saying my warranty has been voided. I asked why and they replied and told me "you have dropped your phone and caused physical damage to the headphone jack". Only problem is, I have NEVER for all the time I have had my phone dropped it. They then told me it looked like I had becuase it had scratches on the back cover, which i then replied to them happened because I put my phone in my handbag or pocket which always has keys in it.
They would not even listen to me and kept reading what sounded like a script, so then I agreed to have the phone sent back to me as they said they would print photos off of the damage and send them so me.
Once the phone arrived and I looked at the pictures, I had never seen this damage before on my phone as it was now visable from the outside. Before I sent the phone away to repair I had fully inspected from the outside what my headphone jack looked like as back on the first day when I bought the phone a small piece of plastic was lose and fell off. This crack and bit lose in the plastic was never there before I sent it off for repair and nokia claim it never happened in their engineers hands, which it clearly looks like it did.
Now whenever i phone them up or send an email to them complaining they always put me through to the same woman who just reads off a script and tells me "your warranty is voided as it looks like you dropped your phone and caused physical damage".
I even tried telling her that if I did drop my phone then surely my glass screen would have smashed in which she replied the same thing about the warranty being voided and I would have to now pay to get it fixed.
Someone please help me on what I can do and what rights I have as I absolutely swear I have never ever dropped my phone and so I don't see why they are going to make me pay to have it fixed when it should still be under waranty if they did not void it!

County court. Nokia won't turn up, the judgement will be automatically awarded against them.0

but they can still contest and get setasideDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

What was exactly was wrong with the headphone jack?lizpriddle wrote: »I sent my nokia n8 off to repair because the headphone jack had never worked properly ever since i bought the phone back in aprill 2011 and the battery was not holding charge.0 -
Did you buy the phone from Nokia or through a retailer? If it's through a retailer all your rights are through them not Nokia.0

Which expires when a 3rd party intervenes. The original retailer is no longer obligated under these circumstances.0

Trouble is over 12 months with a faulty headphone socket and only recently have you decided to get it attended to?
County court and all that? time and money better spent buying another handset.0
