    If your neighbours are using the right of way while your child is out playing in the garden and leaving the gates open for them to wonder then they really are inconsiderate.

    You still need to baby proof your garden - if the spring doors don't work then you will need to fence off more of the garden. If the ROW is anything like other terraces I've seen then it is just a narrow path at the back of the house and you can fence the other side of it providing a safe area. There's nothing against the law about being an inconsiderate jerk sadly and if I were worried that someone would let my kids escape I would either only let them out when they are supervised or make sure any area was fenced and safe if said inconsiderate neighbours came through their legal right of way.
  • Yes it is inconsiderate for them not to shut the gate.....

    Others have highlighted far more important issues than being right on this though. Have you fitted the self closer yet whoch will solve part of any potential problem and maybe have a word with next door to see if they will fit one (or you fit ot for them as its for your benefit)

    However i am still struggling personally with a 12 month old toddling round out of sight on their own in any garden

    Personally I never would buy a house with ROW across the garden, just saying.

    Your neighbours cannot damage your property to gain access, they would be committing criminal damage but they could take you to court over it.
