How does Expired MOT affect insurance claim?

    You are still entitled to claim against the other people if they are at fault, the only difference the lack of an MOT will have is that if the car is written off it will reduce the amount you receive.

    So, I'm the perfect curteous driver, look after my car, maintain it well, don't ignore any knocks, rattles or performance issues, never had an accident , and I shouldn't be allowed to drive because I forgot a date 12 months ago they don't even remind you about.

    BUT, I'm allowed to drive so long as I remember to have my MOT done on th correct date, no matter how I drive or maintain my car.

    It happens, I missed mine this year, by a week, but my car flew through after I had realised and booked it in. The reason my car flew through is because I look after it.
  • Had a crash this morning on black ice, no MOT but insured, i was actually on the way to a pre booked MOT with Kwik Fit.
    Am I covered, currently with Equity Red Star.

    You should be covered as long as the car was actually roadworthy and all other policy conditions have been complied with. However, if your vehicle is a total loss the settlement value may be reduced due to the lack of valid MOT.

    See general condition 6 in the policy booklet below, ERS do not stipulate that a current MOT is a requirement. Quite sensible really, given that any condition which does purport to exclude claims where there is not current MOT certificate is unenforceable anyway.

    Thanks for your reply, do you think I should tell the truth from the off regarding no MOT. As I don't feels easy not telling the truth & would worry it might come up later on in preceedings from maybe the other peoples insurance company.

    You should tell the truth, but that doesn't mean you need to offer any info that isn't requested.

    So cross the bridge when you come to it. (The legality of you driving with no MOT is a concern for the police, not the insurers). Presumably the damage means it will now fail, but if not, then get it tested and you can forget about this.

    The only insurance implication should just be should they decide to write off your car (as a car with a current MOT is generally considered more valuable than one without a MOT)
  • Hello, ok so its been 3 years since this topic was on the go but question.....

    I had an accident just over a week ago my fault and the car has been deemed a write off, so as requested by my insurance company I started hunting out all documentation to send to them including the MOT certificate only to find that my MOT expired in November 2009. No excuses I simply forgot when I had, had it done.

    So I guess what I'm asking is due to my MOT being out of date does this invalidate my insurance and where do I stand in terms of any monies that may have been due to me or any payment for damage to the 3rd party vehicle?

  • hi there... commiserations, i know exactly how u feel... i'm in the same boat because i discovered last night that my mot ran out a couple of weeks before an old man drove into me... i hope it turned out ok for u...any info would be really welcome...regards
