Issues getting deposit back from previous rental

Hello all

Firstly apologies if I'm repeating previous threads, but I couldn't find a suitable one when I looked.

We moved out of our old flat last month (23/08) and are due deposits back we had on the properties.

The old house was managed by one company, who deal with the tenants on behalf of the landlord, who we have no contact details for. We are getting very frustrated with the management company as they are telling us they cannot return our deposits until any deductions (we expect a cleaning fee) are agreed by the landlord. However, they are telling us they are unable to get hold of the landlord and can therefore not process the deposit return.

I personally could use the money now, yet the management company are saying they can only wait until the landlord responds to their proposed deductions.

Is anyone aware of a way I could speed this process up or whether there's anything in place for such situations. I may have to get a payday loan to cover the rest of this month at this rate and I find it unfair that I have to shell out the costs of such a loan when technically I'm owed the money.

  • my deposit is in a scheme and they have just told me the landlord only has 10 days in which to contact them with a figure to repay or reasons not to pay any.
    I can dispute this with them if i have valid reasons. I have certification of all this!

    SO i guess you are now over the 10 days which stands in your favour depending on who is holding your deposit.

    I hear so many people having problems getting deposits back.

    It has made me more vigilant for a property i am moving into which has a huge deposit!!!
  • Not 100% but pretty sure it's the DPS one. I only spoke with the management company today so will be looking into the exact scheme later tonight.
  • yes phone them and they will also help you and tell you necessary procedure.
  • My flatmates just been looking through his paperwork and we can't seem to find any details about the actual deposit. Am I right in thinking we should have some form of certificate of sorts with account numbers etc? If we've misplaced these what's the procedure for firstly finding what the scheme is and then recovering the details?
  • When did your tenancy start? Assuming it's after april 2007...

    Your deposit should be in either TDS, mydeposits or DPS. You can go on each website and see which one it's in.

    The landlord has 30 days to protect your deposit from receipt and TELL YOU which scheme it is in. If he/she hasn't done that, you are well within your rights to take your landlord to court for the deposit, plus one to three times the deposit.

  • The tenancy started last year. So I should be able to find the address on one of the three websites? The issue is that I do not know the actual landlord's name or details, the letting management company cannot get hold of him, nor will they give me his details.

    So given I moved out on 23 August, the landlord has until 23 September to get back to me. After that, he becomes liable for breaching his duty to process the return of my deposit?
  • If you find your deposit is in one of the schemes, request it back, in full. Did you have a joint signed inventory at the start and end of your tenancy?

  • Ah, my flatmates just found his certificate. He's with TDS so I assume I am too. I've just requested my own tenancy deposit certificate from the letting company so should have those details soon.

    We all moved in on separate dates, but the guy who moved in first had an inventory carried out. Myself and the two other tenants never had an inventory carried out when we signed up. To my knowledge, the inventory check on moving out only identified one issue, which one of the lads is liable for so does not affect me.
