ebay problem with seller ???

Hi, I have been reading this forum for a few weeks and it has been a great help but this is my first post, I purchased a samsung mobile on ebay, it was described as being in mint condition, as it was for a birthday present for my 11 year old son I sent an email to confirm that the phone was perfect and had no signs of wear and tear, i was informed by the seller that the phone was as new and mint condition with no wear at all. I was happy with that so purchased the phone and paid by paypal. received the phone, it was a total state scratches on front screen scatches on inside screen ( deep scratches ) silver colour rubbed of on casing a chip in the plastic casing etc. I then sent quite a few emails to the seller but was ignored, I then complained through paypal and the said they would look into it. Now here comes the stupid bit, I went to cancel a complaint I had from ages ago but cancelled this by mistake, I phoned paypal right away but was told that they could not restart a complaint, I then contacted ebay but apart from banning the seller they could not help. I know that due to my stupid mistake I am probably stuck but if anyone could help I would appreciate this a lot, Cheers .

If paypal and E-bay won't help then you only really have the option of civil claim, but that costs money....

I did not think that there was much else I could do, but what I would love to now do is leave neg. feedback, I have never had to do this in over 110 sales and purchases but I think that this is deserved, the problem is I do not want to give them the satisfaction of leaving neg. feedback for me, they have only a couple of transactions on ebay. I do like to receive good feedback because then I know I have given my best when it comes to customer service. as much as it angers me I think it might be better to forget about it all ( but £80 down the drain AARRGGHH !!! )0

That is the only problem is that if you leave neg feedback, then the likelyhood is that they will too....
Difficult... I would be inclined to give neg feedback, as how is one neg feedback on your account going to make a difference... ie if you have 100% now, that would only probably go to ninety something.... ?** Getting back in the swing of saving again.... **

Thanks for your advice, to make sure this does not happen to anyone else I will probably leave neg. feedback, I do have the sellers contact info. like phone no. but not sure this would be a good idea, thanks.0

Why not try and ring him GG? I know it may sound a bit daunting, but it might just give him the wake up call he needs. If you can ring and tell him that the phone is not in the condition he stated, and you will be taking legal action unless he refunds you, it might just work. If not, do leave negative if you can to warn others of this seller, so he doesn't do it again to someone else.The main thing is to keep the main thing the main thing:)0

Someone else suggested on another thread that if you are going to give negative feedback, leave it until the last possible minute. You have, I think, 90 days to leave feedback for something after the sale. If you left it to the latest time on the 90th day then they wouldn't be able to leave you a negative back. I think this is worth a try.
Next time I have to leave a negative I shall try this as I have had retaliatory negative feedback before, which is very unfair as I wasn't the guilty party!0 -

perhaps burbs should think about starting up a little business, to, 'help people out' with refunds lol
i would definitely ring, there is nothing more embarrasing for the seller if you call them at home.
people often hide behind the annonymity of email to ignore you or even send abuse.
just remember keep your cool, dont shout or anything - make sure you look good and sane right the way through.
also i wouldnt mention the fact that you accidentally cancelled the complaint, just play dumb, try saying you were told to try ringing. if the seller suggests they have no responsibility esp. as you cancelled the complaint, suggest you've started up another.
most sellers/buyers i have dealt with on the phone have crumbled, people just don't like a bad transaction or their own awfulness to be so directly placed in front of them.
could just be my terrifying phone manner though.

have you heard anything encouraging from the seller?
also, ring as SOON as you get the number in an email, cos they get one too stating their address etc has been requested...if you leave it too long, you just may find yourself on the end of a long ring tone, unanswered.
a buyer once answered the phone to me but then wouldnt speak and hid it under a cushion.0 -
good option - to phone them but most people do leave a false number! - I doubt they would be intimidated.
Why don't you take the phone to a phone shop and see if the damage can be sorted ...eg if it is just the cover or screen it may be replaced this way it may cost £10+ but at least it wouldn't be such a waste of money! and if you are not gonna get anywhere anyway with ebay and paypal then just put it behind you as "experience" A lot of people on here have been through similar things as have I so we can sympathise with you!
I HATE people who can't at least be honest for just a few extra Pounds! I would feel terrible if I sent something knowing I hadn't been honest!
I expect as the person hasn't got such a good feedback score then it isn't important to him! although it would damage his account more then yours and you can always follow up with a comment that it is retalitory feedback as he was in the wrong...see listing or email for details!

thats a good plan, the only problem would be remembering 3 months down the line.
i understand the bad feedback problem, but one bad feedback aginst you is unlikely to deter people.
What would they say anyway? that they left bad feedback as they didn't like you?
if people checked the history of the item it would be obvious you payed on the listing, especially with paypal payments.'What's poignancy grandad?'
