CUSC foneguard mobile phone insurance

Any one had dealings with this company??
I took this insurance out for my son's iphone as recommended by this website, 18 months into his phone contract his phone was stolen out of his pocket.
The underwriters, Pier insurance are saying he is not able to claim as the phone was taken without threat of violence.
This is not my definition of theft indeed that in my opinion is robbery.
Their website still says that for the premium he currently pays they cover phones for theft and loss.
I intend to ring them again tomorrow to find out why he is excluded but just wondered if anyone had any experience of this company?

Here's an extract from their wording:-
theft of the Electronic Equipment from the person of the user unless involving force or the threat thereof
I'm afraid your (or the legal) definition of theft is irrelevant. They just don't cover theft unless involving force or the threat of force.
Did you have standard cover or cover including loss?0 -
It may be covered on your Home Insurance and they don't tend to be so strict on theft claims, look on your policy for cover for "Unspecified Personal Possessions or Belongings or Effects"0

it is covered by my house insurance but to me this is irrelevant we were paying for a specific mobile phone cover. It was my understanding he was covered for theft and loss0

I don't mean to sound harsh but you only partly understood. Is the wording in your policy the same as above? If so, he was covered for theft, as detailed in the policy.0 -

Well it looks like its not covered.
Do you actually know it was stolen? Would he have cover if it was just lost?
Careful though, insurers don't like stories changing to suit the policy.0 -
well I did challenge this with the underwriters but they said he was not covered for loss either!!! They have some paragraph that makes no sense but apparently it means its not covered for loss.
We think it was taken from his pocket but he is not 100% sure.
I will be cancelling that insurance if not covered as its a waste of money and not what I thought it was0 -
Accidental Loss means that the electronic equipment has been accidentally left by you in a location and you are permanently deprived of its use.
You also need to be able to say exactly where and when it happened.
That's a pretty limited wording but probably not unusual for mobile phone insurance. I have never had mobile insurance myself.0 -
tbh I took it out as it was a company recommended by this website.
I think the wording for loss is different to what you describe0 -
it states ' loss of the equipment any other costs that are directly or indirectly caused by the event which led to your claim unless specifically stated in this policy0
