Not giving notice?

I had an unexpected telephone interview today for a data clerk job that I mentioned yesterday, they said if successful they would let me know by the end of the week for a start on Monday. I generally have to give a weeks notice at work but I have heard colleagues say when someone hands in their notice the boss send them home as he doesn't want any messing about, I might not even get the job but if successful what would you do? I will loss my weeks pay I am aware of that but hey I have been looking out of there for a long time, What about a weeks self cert sick then leave is that legal?

    Have you read the posts from other people who have asked about leaving their employer without giving due notice?

    Did you lie to get time off for the interview today? Or did you tell them you were going for an interview or did you just take a day's leave?

    Why did you suggest to the potential employer that you would be able to start on Monday?

    If you did walk out without giving notice you wouldn't lose a week's pay though, would you? You would get a week's pay from the new employer.

    Self-certifying as sick when you are actually working somewhere else is not truthful. If your new employer wanted you to do that, they would not be good people to work for.

    No its not legal to self certify if you are being paid or getting statutory sick pay at the same time. Also if you have started work elsewhere then you can hardly claim to be sick at the same time and could be found out.

    Just tell you boss you need to leave at short notice. You are technically in breach of your contract but I doubt they would do anything about that unless your terms of employment include some enforceable penalty (eg replayment of training costs). You will lose your pay and risk being given a poor reference. Only you can say if this matters.

    No didn't get out it was a telephone interview however do have to get out later in the week for another interview. The job advert stated immediate start, I just didn't count on things going so fast.

    You mean if you go in on Friday and say here is my notice I leave in a week your boss says go home?

    If they do so they have to pay the notice therefore you will not be out of pocket, will you?

    You are going to lie to get sick pay? You will only get what, erm 2 days SSP? A good way to leave a job.

    I have read a lot of your posts about work and your job and when you never had a job and I do wonder if you are for real?

    I should add that leaving without notice is more problematic in some jobs than others. If its a fairly unimportant role then then your Breach of Contract will most likely be ignored but if you seriously inconvenience your employer and you are in a responsible job they could sue you for their costs in employing a temporary replacement.

    They may also delay your pay until the end of the notice you are required to give or your normal payday.

    you tell them you can not leave with one days notice but you have to give a week of whatever you have to give and then like you said your boss will tell you to leave so whats the probelm?
  • If you are Self-certifying when at another job how bad do you think that will look to the HMRC? You have thought about that?

    Falko apologies ive not kept up, are 1 of these interviews linked to what you were contemplating what to do with regards to an interview eg pull a sickie or have a "dentist" appointment to attend.

    It's perfectly conceivable to have two separate and different jobs, one of which you could be unable to perform due to sickness/ injury while the other was unaffected.

    Both of which are full time at the same time. Oh yes then there is a start date which is not till the first day of your mystery illness at the 1st job.
