Think about what your doing, as if you were to leave your current job, just leave without notice, and the other job fails, or something goes wrong, you cant turn back the clock.
If the worse did happened and you had to claim jsa, everthing catches up with you in the end, so think wisely.0 -

Didn't you offer the same advice to someone once saying nothing would happen? I and SarEL said that they could get sued, everyone else said no employer does and then a couple of weeks they posted again that their employer was suing them...0 -

And the employer LOST. Talk about a selective memory and half a story!
I for one have never ever said it can't happen. Only that it is very very unusual and that several regular posters on here (you included) seem to love to wildly overstate the chances.
As has been explained before, to have any chance of winning such a claim the employer would first of all have to actually suffer a quantifiable loss despite making all reasonable efforts to minimise it.
In the real world, when only one week's notice is required, the obvious safe thing to do is to self certify as sick. This is virtually unarguable. In fact a perfectly reasonable argument could be made that, if you have reached a point of being so unhappy with the job that you cannot face working a week's notice, you are suffering from stress anyway.
Although I wouldn't recommend it, it is also perfectly possible (legally) to be off sick from one job yet be fit for another. Unfit for manual work but OK for clerical is the most obvious example but work related stress can be another.0 -
I still don't understand why you think the prospective employer expects you to be able to start work on Monday, surely if you tell them that you have to give a week's notice they will accept that and allow you to start when you have legitimately finished your current job? Of course, you may find that you are sent home when you hand in your notice, in which case you can ring up the new employer to say you are now available earlier than expected, and they may be prepared to let you start straight away, in which case you'll get paid twice for a few days.0

I've walked out of a job for a better one before.
I hated the job I was in, the people, the manager the customers, the environment...everything. I got the chance to interview at a huge company I'd always wanted to work for. Needless to say I got the job, told them I could start ASAP. I walked out of my rubbish job on the Friday night and never went back, started at the new place on the Monday. Been here 9 years now.
I didn't get sued, I even got paid up until I walked out. My first priority was me and my mental health, not the rubbish job I was doing so I wouldn't have to claim JSA.0 -
If there is a tradition of your employer sending people home when notice has been given try giving your notice in early, but them sending you home you should still get paid for the week worked and then your week in hand.0

Do you have any accrued holidays that you could use to off set the notice period?
They may allow you to use that instead of working the notice.0
