Thanks for your advice Cpt.Scarlet what you say is basically what the CAB advisor and the first gentleman we spoke to at Hull Benefits Centre said yet the woman at new claims said there was no way he could make a new claim. I don't know what or who to believe anymore. I'm physically and emotionally drained and so fed up with it all I could cry. It just seems like they make it so difficult for people to get the help they need.
DWP sadly is appalling at providing basic information and advice to customers. But what is most troubling is that rather than say 'I don't know' they seem to instead give incorrect information. I agree with Scarlet's advice. I would try your best to get your doctor or a specialist to detail the 'change in medical circumstances' for you to send in addition.
Oh.. and reading back.. I agree with the CAB advice.Have just spoken to the adviser from CAB and she seems to think that we would be better off putting in a fresh claim for ESA based on the change in
circumstances but keep the original appeal open as if we win it we will be due

Be careful here, is your current appeal against the failed change from Incapacity benefit to ESA?
I ask because if you let that appeal drop you will be assessed on an income based ESA claim due to your husband not paying NI in the last 2 years.
The appeal tribunal can only assess your husbands eligibility on the day of the fit to work decision being made, these new injuries cannot be assessed in this claim.
Keep the current appeal going and submit a new claim with the current injuries.
As for DLA, you have to have care/mobility needs for 3 months before applying and your doctor should expect no improvement for at least another 6 months so that isnt a consideration for now.0 -
Challfour joined on 4/9/2012 and has averaged just over 14 posts per day and I am sure we are all totally fed up with him trying to, and succeeding (with a few) in winding people up who could do without it.
Challfour should spend his time on the Discussion Time board and get ripped to shreds by those on there who love an argument which is why Challfour frequents this board.
