My right with car bought from dealer - clone

Hi all,

Briefly, I bought a car from a dealer about 2 months ago, and after applying to register the car to my name, I got a letter from the DVLA saying it needed inspecting.

I took it down this morning and they said it is very likely the police will be in touch as it is 'suspicious' and probably a clone. They gave no other details.

I bought the car as part exchange with car and cash. The dealer is local and has been place for a couple of years. Does anyone know my rights with regards to buying a clone from him? Is he liable for selling me a dud, or do I have to take the hit? The car is only a couple of years old and cost a lot of money.

Any advice is greatly appreciated.

    He was probably suckered too with HPi not being updated fast enough when he took it in, but it really is down to him if the car is as you bought it.

    If it turns out to be a clone, its because its stolen.

    If its stolen, then it belongs to the insurance company.

    They will reclaim the car from the current owner - in this case the o/p.

    The O/P will then have to (try to) reclaim the money from the dealer.

    So quite a lot of it will be the o/p's 'problem', at least in the short term.

    Lets hope the dealer stumps up.

    kjrbetts have you contacted the dealer to let him share the worry?
    was it a good clone or just a sticker in the window basically

  • do yourself a favour and not drive it anywhere. it will be flagged as a car of interest on ANPR and if it turns out its stolen youd be arrested untill your proven innocent, and then have to walk home.

    I wouldn't do that just yet. If its an expensive car it could potentially put the dealer out of business if their insurance doesn't cover it (probably does if he didn't do an HPI check etc then he might not be covered). That being the case, if he gets notice of it he may wind up the place and be gone before you stand a hope in hell of seeing your money back.

    Best keep quiet for the time being IMO. If the car turns out to be hot then you can point the police in his direction and then take action against him to get your money back.
  • I wouldnt notify the dealer until its been checked also.

    They may vanish overnight. I would wait to find the verdict and then go down there with the police.
    They maybe the people cloning them.

    Also, did you pay for some or all of the car on credit card, e.g. a £100 deposit? If so read Martin's Section 75 guide. It's not just for faulty tellys.

    If a consumer buys a car from a dealer with credit outstanding on it without knowing such, then they have some protection from the insurance company taking the car. I wonder if there is any kind of similar protection in this situation?
