Child Benefit change of circumstances Question

Hello

I had a quick question about Child Benefit, I recently broke up with my ex partner
We have the child 50/50 so we split Child Benefit/Tax Credit between us

Basically she have NOT let the Child Benefit team we have broke up it’s been almost a month or change or change of address etc

I am worried that my Childs money will get stopped due to her not informing them

I asked someone at the job centre and got told that you can only claim child tax credit if your getting child benefit so if child benefit gets stopped then is it true then tax credit will also get stopped

She has had tons of time to call them or use the free phones in town at the job centre as she’s in town quite a lot maybe 2-3 a week shopping with friends

Im thinking of ringing them and just starting the claim myself as I have given her time to call them and reminded her to do it when in town to call them but she never does it

Its get split 50/50 either way so I don’t see what the problem would be,

Any Advice

  • Child benefit - and the linked benefits that go with it cannot be split. In the event of a 50/50 split of care, the parents need t agree who gets it.
Rationally, you need to sit down and work out which way of claiming benefits leads to more payments.
It could well be that leaving the existing award is the beat thing to do, then splitting the money.
  • We already split the money via Standing orders/direct debt between us

we cant keep the existing award due to it had to be changed due to change of circumstances ie breaking up and change of addresses

so I guess main question is what happens if she don't inform that of the change (child benefits) will money get stopped for certain amount of months And will it effect tax credit once it gets started again

tax credit has been stopped recently due to change of circumstances and have to refill all the forms in

don't understand what you mean by LINKED BENEFITS as when we was a couple one of us was claiming tax credit and the other was calming child benefit as we did it that way to know what money we had etc and one of us use to buy certain stuff for child with one use to buy then nappies etc

so hence why i am confused more on this matter

child benefit does not need to be informed that you have sperated.

it's only tax credits that need to be told.

Roger's right, only the person claiming CB can claim CTC.

If the mother has changed her address she must tell the benefit office, this can be done on line.

Well how was it when we was a couple for 3years i was getting the CTC and she was getting CB?

If the person whos caiming CB can only claim CTC then it dont make sense why we both claimed them in the past?

its been a month and she made no effort to do this, she has a computer at home but facebook is more important to her so all the time on the computer goes on facebook games or whatever other rubbish on facebook

she been in town 2 min walk from the free phones at the job centre but again not informed any one

that's the main problem. she don't want to make the effort to change it and when i asked the guy at job centre about it he told me that it could get suspended for a short period of time

I am trying to sort out my child's benefits but cant really do that if she don't make the effort

Tax Credit was in my name for 3years
Child benefit was in her name for 3years

I informed tax credit of what happened, got forms sent out for new tax credit to me

I don't want my child child benefit getting stopped because she not making the effort

I feel like just applying for Child Benefit myself as it saves so much hassle

if it gets split 50/50 don't see what the problem would be myself but i don't understand how that works if a claim is already in progress (but the mum has not informed any changes for a month now

The issue is that child benefit causes entitlement to other benefits.
The person with child benefit is assumed to have caring responsibilities.
This means other benefits can be claimed by the person getting CB.

However, the amount of these other benefits may differ, depending on the person getting CB.

To take a contrived example - if she was earning >60K, she could not get paid child benefit, but you could.

Or if you claim CB, she may not be entitled to help with childcare.

You need to work out the benefit entitlement in both cases, it may be more for claiming one way round than the other.
And clearly if you split the money from the way round that gets most money, you get more money.

I think you need to calm down....CB is different than CTC, CB is paid regardless of income therefore they dont check up on addresses etc in the same way, i moved several times when i was recieving CB and never informed them,(was'nt aware i had to then) and they never stopped my childrens benefit. Im sure your childs mother will do it when she gets round to it.

You claiming CTC and the mother claiming CB was exceptable while you were still living as a couple, but now you are not, only the person claiming the CB can claim the CTC, the person claiming the CB is usually classed as the main carer.
