How do I claim my stolen goods back?

Hi,
Cash Generators are in receipt of my iphone, I and the police has told them of this and they have since purchased other products from the person who sold them my phone.
How can I get my goods back. They paid £40 to the person concerned, who is a known criminal and does have a record, and they want me to pay £90 for its return.
So not only are they in receipt of stolen goods (they have my daughters laptop too) and then accepted further goods from the thief, they then want to make a profit from me!!!
Has anyone had a similar experience and taken the matter further. I am going to go to the small courts as I am fed up of guilty parties getting away with it just because they are an organisation and bigger than the indiviual, but wondered if you had any additional advice.
Thanks

Have you already received any insurance payout following the theft? (Not sure it matters, but might muddy the waters somewhat).
Can the Police not issue a seizure order on the goods to get them confiscated and returned to their (proven) rightful owners?0 -
The police do have the power to seize the goods and would do so in a straight forward theft case, what are you not telling us about the person concerened? Is there some sort of civil matter regarding the goods, your daughters boyfriend perhaps? As you know the person concerened, there must be a reason he hasn't been charged ang the goods impounded as evidence to be returned to you later.0

If the police are involved, have they arrested anyone for handling stolen goods? How did this 'person' come to be in possession of your iphone and your daughters's laptop - was your house burgled?"You were only supposed to blow the bl**dy doors off!!"0

I do not understand this.
I have heard many a time that if you buy goods and they turn out to be stolen they can simply be taken away from you and returned to the rightful owner.
Why are the police not taking further action ?0 -
I was selling my phone and my daughter took the phone to a person she knows as he said he wanted to buy the phone but wanted to look at it first.
Unfortunately, she is now going out with this man. The police have said that there is little they can do as it was my daughter who initially lent the phone to the man, he can say that gave it to him and there is nothing we can do.
I can say that my daughter stole the phone, but that isnt strictly true, she has never done anything like this and I do not want her to have a criminal record, which could affect her whole future, simply because she leant the phone to someone who then sold it on.
It is so frustrating.
By the way we do not agree with the relationship, but when I insisted she didnt see him again, she left home, something that obviously I do not want!!ACII and Chartered so now I can focus on learning to play my beautiful Sax. 🎷0 -
I do not think you have a leg to stand on taking this to court.
No one will understand why your daughter is still with this man if he has 'stolen' your phone, and if anything, she will be seen as the one who has 'stolen' it.
She would more than likely say you gave it to her and then changed your mind.
You will have to put this one down to experience.0 -
You have two options:
1) Buy the phone back
2) Report your daughter to the police for theft. She has taken the phone and refused to return it.
It might sound harsh, but unfortunately those are your options - unless your daughter is willing to report the man in question for theft.0 -
She is, as she knows he has done wrong, but the police said that he will more than likely say she gave it to him

I would hate to blacken her record, when she actually just took a phone to him to see if he wanted to buy as I was selling.ACII and Chartered so now I can focus on learning to play my beautiful Sax. 🎷0 -
Did she give him her laptop too?
Unless you're willing to report your daughter for stealing from you, or she to report her boyfriend from stealing from her, Cash Generators aren't selling stolen goods.
If you want your goods back you're going to have to get tough on your daughter and 'blacken her record'Accept your past without regret, handle your present with confidence and face your future without fear0 -
Forget the property and sort out the real issues. Out of interest who was using the phone last (I suspect it was a phone you bought for your daughter).0
