Debt Help required please

Im new to this and im sorry for posting it here,
I have had problems paying my unsecured loan, which is 12k, It has already defaulted and went to a debt help centre.
I'm not having issues paying that,
I got married recently and changed my name and moved address, i did not inform my bank or this name change or debt people, its been about 4 years now, but I have not told them I have changed my name or moved address.
I have not used my old name for anything anymore, I use my new name which on experian has good credit rating when i checked it.
my question is, I intend to pay it back when i have money, but im living and paying for food and rent at the moment.
I do not own a home or mortage, cant they still find me and take my belongings away from me?
I'm worried, it defaulted about 3 years ago, and ive been working like a dog to pay them back,im not well at the moment, and i cant afford to pay them, Im trying best to pay them, but i cant anymore.
Can they take my wages from work? I only earn 1495 after tax, it goes into Rent, food and getting to work, I dont buy new stuff, i dont buy games, i dont go out, i dont treat myself to anything, i just have about £22 left over after everything has gone out in terms of bills + rent.
I have new accounts with Santandar with my new name and its not linked to my old name in anyway, I have checked my credit profile on experian and it only shows my new name and new accounts.
What is the worst they can do to me if I cant continue to pay on my defaulted unseured loan?
any advice

Worse case?
They'll make you bankrupt (depending on how much is left to repay)
Most probable?
They'll get a CCJ against you, if you can prove you have so little to live on then they probably wont bother with an attachment of earnings.
The loan is unsecured so no property can be taken away from you.
They will probably link your old credit file to your new one, but given the above then your credit file will be trashed anyway.0 -
Also pop over to the Debt free Wannabe sub forum and post your SoA (Statement of affairs) , the people there can analyse it and see if you can make savings in your outgoings.0

I feel like so depressed with everything.
I feel like running away from everything and ignoring it all!
I', just so lost, Ive been paying through the CCS and they have been helping me.
Maybe life after death is better!!
Im just stuck, I know my credit history will be trashed either way, its already defaulted on my old name, i checked that credit report and it was trashed, this new one is ok. its not linked in anyway.
With the attachment of earnings, because its 12k will they do everything in there power to get me.0 -
It's only money dude, nobody is going to flog you for it.Mavrick101010 wrote: »With the attachment of earnings, because its 12k will they do everything in there power to get me.
Worse case is you go to Court for your CCJ. You fill out an SOA which lists ALL your outgoings and commitments.
The Judge looks at it, turns to the creditors and says, "This bloke is skint, you can have £1 per Month and you freeze interest"
Nobody is going to take so much you have nothing to live on, you will be left with enough to lead a reasonable life.
The depression comes when you are not in control of it and can't see a way out, NOT because of the level of debt.
Read through the Bankruptcy and living with it board (I'm not suggesting you do this as £12k is not much at all). You will see people who were in a much worse place but feeling great about life now.
Speak to the CCCS again or even go and see the Doc, this problem you face is more common than you realise.0 -
As ^above^ it is only money and there is help around.0

Will they just to the attachment of earning without contacting me first cause i would not be able to afford it if they did it without my permission, I wait for the CCJ SOA and prove what i can afford but im dying at the moment with worry!!!
I hope it does not come to that, is it likely it will?0 -
Not informing your bank of change of name and change of address.
Earning £1500 a month and cant afford to make payments to your loan.
Pull the other one!!!0 -

Well you do not know what im paying out.....
I dont think its fair your comment, if you knew im sure you would apologise.
You should not judge people!0 -
You do need to look long and hard at exactly what you are paying out. Your income is fairly decent.Mavrick101010 wrote: »Well you do not know what im paying out.....

Go to that site and fill it out as accurately as you can. Post the results up on the DFW board.
You MUST haul in those outgoings if you are serious about this. If you won't change your standard of living, then you will find no way out.
If a CCJ is incoming, you will receive notice in the post. If you ignore it, you could find an attachment of earnings arriving. DO NOT IGNORE IT.
If a CCJ arrives, the SOA above is exactly what you need to demonstrate what you can afford.
If you have Gym membership, iPhones, XBox Live subs and Sky Sports packages on it, you may as well throw the towel in now.0 -
All i have is internet and my phone contract, I filled in the sheet and it said im -£66.76 surplus, but right now its because i have to put money aside for road tax, car maintaiance, and its only £30, plus road TV is its £35 every couple of months, sometimes i do not spend much on food and try and stuggle with what i have.
I'm going to cancel my sky monthly which is £20 so that will help!!
But apart from that its all Bills, Gas, Electic, counil tax, Rent is £595 a month and its close to work so its cheap on petrol, but still cost £200 a month to travel to work + visit family etc.
I do not put money aside for going out cause i just cant afford it, i've been trying to look for a job which pays a little bit more, but its so difficult!
I will call CCCS today and see what they say, cause I cannot afford to live this way, the constant worry.
I wish I never got an unsecured loan.0
