Default Removal

Hi there,

Not sure if this is the right thread but here goes. Im not going to dish out a sob story but a default was placed on my account 3 years ago the account was promptly settled and the account closed. Im now in a situation where im looking to buy a property, my credit profile is absaloutely spotless (809) with no late payments or defaults but the default is seriously affecting my chances of mortgage.

I started of by firstly asking politely if the default could be removed sent my credit profile proving my previous track record and that it was a one off mistake to which Home Retail Group or Argos took 8 weeks to reply to saying ultimately saying no.

I took a more aggressive approach following this requesting a copy of my CCA under S74 so I could then dispute and issue a S10 Data protection order to remove anything from my credit profile.

Argos replied saying because the account is settled they aren't obligated to send me a copy of my CCA, is this true? anyone have any ideas how to proceed from here? as I know they were well within the rights to issue the default is seems harsh with my previous / current flawless payment history.

Many Thanks

Sam

They won't remove it whether it was a accident, a mistake or your Aunty Mary did it, you still defaulted.

Getting arsey with them and quoting numbers and letters won't help.

    Just accept it.

Do a search on the debt free wannabe board - I havent done this myself but know there are threads related to this that others have.

  • It's extremely unlikely you'll get it removed unless they made an error (no record of issuing a notice of default for example.)
    Defaultless as of 12th Sept 2012 :)
Listen here default Dave why don't you take your bullsh*t and stick it up your defaulted ar*e and then stick your defaulted credit report and stick it in your defaulted gob.

if its correct no s10 or any other will remove it, op you cant buy a clean file
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
  • Jinx thank you for your helpful response, the rest of you not so much.... I thought this forum was a place to get helpful advice to improve your financial situation not be ridiculed for previous mistakes and errors

This is a forum for giving correct advice. Whether you think it's helpful is up to you.
Please point out the ridicule, cos I don't see it.

But the advice you got is the right one.

The CRA report what actually happened, you defaulted so you cannot get this removed.

I think Bugsy's advice was that the score you have means nothing, no lender uses those scores as they have their own internal scoring mechanism.

Given your join date I thought you would have seen how often this very question is posted and answered as such?
  • Excuse me, my response is factual from personal experience. I haven't ridiculed you at all.

  • Yes I appreciate that the response I got was probably correct but a certain amount of sympathy and social tact to the situation is clearly amiss. I don't need to be reminded that this is my fault i'm fully aware of that with my current situation trying to sort out a mortgage. I came for advice a simple no its not possible or perhaps something constructive would have been superb!! not the fun police charging in on their high horses.....I really feel the urge to come back again....

Look you don't like advice hence the reason you've asked the same question on another thread.

You screwed up pal and the provider was right to stick an adverse on your credit files and good job.
