item delievered even though i havn't paid for it

nearly a month ago now i saw a 'make me an offer' auction on ebay for some stuff for our nursery, i made the guy an offer for £80 but didnt realise that if accepted the auction stops straight away, and after finding out i won the auction decided to get the bits and pieces from another seller for cheaper. I sent the seller a message straight away apologising but never heard anything back, then this morning its delivered! i havn't paid for it! what should i do? it cost the seller £16.00 to be sent and i dont fancy paying that to get it sent back even though it is kind of my fault, but who sends something that isn't paid for a month later? any advice what to do? many thanks

  • I would email the seller explaining that you've received the parcel, and say that you are confused as you've never paid for it. I'd then ask them to arrange collection for the items, or to send you the money to send it back to them. Then see what they say.

    I don't know if these would count as unsolicited goods, but if so, providing you have informed the seller and tried to resolve the issue, I thank that after a certain period of time (is it 1 month?) the goods become yours. However, don't just ignore the seller, as that wouldn't be right.

    Maybe they relisted them, sold them and then got confused and sent them to you by mistake.
  • thats really strange....it's not your fault that it was sent out, you hadn't paid for it. the only way you are at fault is having not paid for something that that you agreed to buy. Maybe the seller thinks that if they send it you will pay for it. I would email them and remind them you haven't paid for it and that you can't understand why they sent it. it they want it back it's only fair they pay for the return costs. Ebay actually mention again and again don't post out anything until you have receievd payment. Seller should know better unless they are a newbie....are they?

    Ahhh.....relisting the item makes sense....if thats the case then yikes to the seller. They really should have removed the first transaction and even cancelled it to claim back fees...£80 is £8 of final value fees :eek:

    How does the seller have your name and postal address if you have not paid for the item? Is it sent in an email when you win the auction? I have my email notifications turned off so unsure.

    ETA: I have just remembered you can click on 'order details' through eBay. Surely he could see the item was not paid for though.

    The buyers postal address is on the "you've sold your eBay item" email.

    thanks very much for your replies, he only has 27 feedback but they are all selling ones, i feel really bad for the guy but i really dont want to be out of pocket, i can't understand how he thinks ive paid unless he did relist the item and has got confused maybe but i made him a offer on it nearly a month ago now, ill try contacting him and hopefully he'll get back to me this time.

    ive just been through the ended auctions and it looks like he relisted the item and sold it on the 26th August! i feel really bad for the guy now, i dont understand why he didnt contact ebay about me not paying for it to get his money back, i just assumed he would
  • Would you be willing to post it on to the other winner if he paid you first....however he would have to trust you to do so
    Never put off until tomorrow what you can avoid doing altogether.:D
  • Well if it were me I have to say I would now send the seller an email explaining what has happened and then I would pay for the item or at the very least pay for the item to be sent on to a buyer or back to the seller, you had committed to buy the item by making an offer to him, when you make a best offer Ebay make it very plain and simple that if it is accepted you are committed to buying, your mistake which has ultimately got the seller confused in some way hence the items have arrived.

    So by you making a best offer and then deciding you do not want the items you have not only:

    a/ Messed the seller around

    b/ legally committed to buying something for a set price and then expected to be able to walk away with no hassle

    c/ cost the seller courier expense in sending the item to you

    d/ probably caused a nightmare for somebody else if the item was re-listed, which brings me on to.....

    e/ A possible negative feedback and item not received case for the poor unsuspecting buyer.

  • It is up to the seller to open a non paying bidder case and he/she did email straight afterwards.....but yes non payers are a pain
    Never put off until tomorrow what you can avoid doing altogether.:D
