Kwik fit warranty on cat less than a year old

  • Does that other act cover me though? It was a private sale, the parts were paid for up front in full by the owner at the time as the receipt details that!

    Getting them to go in is not really possible as I purchased the car from a different driver who bought it not long after the cat was replaced!

    Not sure if they need proof such a driving license.

    Should I maybe ask a solicitor/legal helpline? The t&c's they sent me says "warranty not transferable" but again if another area of law covers me that would be ideal

    It passed emissions but if I can enact a replacement via warranty that would be great - I understand parts fail etc but the frustrating point is it has a warranty and unfair they won't play ball, again I guess I understand they need to protect themselves :(

    On another note, one of their employees posted on FB asking what was wrong and then went on to mention 'not our fault' & warranty isn't transferable' - something to that effect anyway, other half wasn't pleased and said to make a complaint but I don't see te point as I guess nothing can be done about that!
    Any input I provide is purely my own interpretation and is in no way 100% accurate, I will try to help as best I can in all cases.

    Its not worth the time and effort. Contact the previous owner as mentioned and see if they will sort it for you.

    If not them tell everyone you know not to use them and buy a new one from elsewhere.

    your just going to have to take it on the chin and chaulk it up
    just pay up and get it repaired
    how far are youreally willing or going to try and chase them the cat will cost £55-230 depending on engine and cat type, if you try to take them to court your going to lose out as there terms clearly state non transferable
    it did have a warranty but only as long as the orignal purchaser had the vehicle and you are now the 2 owner after them

    It's a shame really, Crapfit probably replaced a perfectly good CAT, which would most likely have lasted the life of the car......

    I quoted this law to a car dealership and successfully persuaded them to agree to transfer the warranty to the new owner when I was selling a car.

    When you buy a used car and it comes with a warranty, usually from companies such as Warranty Direct, that warranty is usually an insurance policy. Therefore you can get away with it under LPA unless it was a warranty the garage was covering themselves.

    However that does not apply to the guarantee on a product bought new. That is covered under SOGA and under SOGA the contract is between the original purchaser and the seller and it is not transferrable unless the seller states it is.

    it says the car was bought privately so no dealer warranty and no guarantee as not transferable
    i appreciate that this is a money saving forum but technically fraudulently trying to claim being the previous owner is illegal

    It appears so, but it had the required effect when I quoted it.

    Perhaps in the 87 years since it was passed some case law has extended it somewhat beyond what parliament originally intended?

    This happens all the time - look at the way the Human Rights Act is interpreted by the courts to mean that convicted killers who are illegal immigrants can't be deported if they've got a British woman pregnant because it would "interfere with their right to a family life". I think parliament would have said that the British Public's right to be protected from such people was more important, but there we are. A completely separate debate, but one which highlights how laws can end up having unintended consequences.

    Seems the best idea. You have the car and receipt, most unlikely to ask for ID!
