How could you not know this was a genuine mistake. It's obvious to me that any company in their right mind would not offer a buy now price that low without some prior advertising.

Probably SPAM but.. I couldnt help but think.

    MISTAKE or just MISLEADING?

    The latter i think.

They do advertise as products for a fraction of their retail price.

In court i produced 64 screen shot taken from mad bid.com showing products with a buy it now price i.e. no need to bid just buy them straight away with discounts of up to 93% off their quoted RRP. The judge felt quite rightly that a reasonable person, when seeing these adverts (all of them were advertised over a 1 week period) woudl assume them to be genuine therefore found in my favour

I think this is the key point with regards anything that has gone on. Madbid are known for their heavily discounted items and thus what you bought was no different.

However, I would be surprised if 'mistake' hadn't come into play if say this was a normal website selling things are roughly their RRP
Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

I agree, it is, as i say what boils down to what a reasonable person would assume. Also T&C's play a big part together with email confirmations confirming orders etc. each case is different and should be treated individually
  • no cheque yet but i have heard from madbid and they tell me it has been posted so i will keep you informed
  • Update.

Well ok, it was 2 days late (arrived Saturday 22nd) but my cheque and my judgement arrived today.

Also, in response to my posts i have received an email from madbid confirming that other who also suffered the same problems as me have now been satisfied with goodwill holidays or payments so it all sounds good in the end.

I would be delighted to hear from anybody who has received a settlement from them.
  • Well i for one as you may remember from this time have received absolutely nothing from Madbid.com since the time we all received the emails to say it was all listed in error and i myself purchased quite a few items at the same time from these supposed buy now prices as advertized i have also not been told by 1 other member that i know from Madbid that they have been offered anything since either and like you from the madbid forum know quite a few i would be interested to see the email that says we received settlement or holidays

Well done harleyfan, glad to hear the result. I remember way back in 2000/01 one of the major consumer electronics stores making the same mistake online - think then TVs were being sold for next to nothing.
Smile and be happy, things can usually get worse!
  • Bravo!
I am absolutely impressed with your preparation and tenacity, as well as your ability to make all the important points and ignore irrelevant arguments!
    Chalk up a deserved victory!

The comment about £46 difference is misleading as well, as the true difference is above £200. To take on an ex-practicing lawyer is a great achievement and you're entitled to be proud!

I think you should now go to the press [I don't know if you could get any money for the story, but it's probably worth something?].
