3 contract how do I cancel!!!

  • The contract for the phone is not the best, even their own web site offers a better deal. So i'm not happy at all about the whole situation the fact that they have given me an incomplete product which is not able to provide the service which they have agreed to provide in the contract imo should surely void or atleast give me a right to cancel the upgrade and return to my normal contract as i have yet to pay the early upgrade fee.

    The phone should never of been sold to me as new if the seal on the box was broken when they handed the bag over to me. The sales assistant sold me the phone knowing full well the item was incomplete and unfit for use in it's current state.

    I can't use the phone as their is no battery, data cable or head phones. So i am gaving to currently pay for a service which i am not getting. An exchange is not good enough, they have crossed the line and i do not wish to give this cowboy outfit any more of my hard earnt money.

    Look - your case is different from 99% of those on here where people simply have changed their minds.

    You have been supplied with (a) a used item and (b) essential bits missing. i.e. it is defective.

    They had no other black one in stock, so you are fully entitled to a complete refund. However, if they find a brand new one and it is available when you go into the shop, then it's a bit different and there is an argument that you might have to fight to reject the replacement, other than to say that, because of their dishonest and incompetent original sale, you have lost all confidence in the shop.

    There is absolutely no discussion about the fact that you have been mis-sold and that you did not receive all of the bits.

    All this 7 days to change your mind etc just simply is not applicable in a case where the goods are defective.
  • Well I can't wait to see what will be said on Monday hopefully things are sorted where both parties are happy. Will reply with the out come on monday.
